Appeal ignored by OPS - now have LOC! Help!

Help please! I received a ticket from One Parking Solution and appealed it instantly (done through their website and stupidly didn’t take screenshots)I had no acknowledgment from them so emailed them to confirm they’d received it, and then they responded that they had. I didn’t hear anything further until I got a letter from GCTT. It was then passed to BW Legal and now I’ve received a Letter of Claim. 

Is this likely to proceed to a Count Court? Does the fact that OPS never responded to my appeal despite receiving it make any difference!

    I know it. You should have parked in Waitrose or stayed on street and stopped at the kerb.

    Show us the PCN, both sides. Redact your car and name/address data & PCN number.

    Was this one of their hidden CCTV cameras high on a building and a lack of prominent signs? Secretly caught you in 2 minutes flat?

    They'd never win in court.

    I’ve turned the house upside down but I cannot find the PCN, Sod’s Law I’ve got all the subsequent paperwork. 

    We do usually park in Waitrose, never there. ( I had to pop into the Guildbourne Centre) there were penalty signs but I didn’t see them as we took our big van and backed into a space. They weren’t there the last time we were there 😬 I’d say the signs were above eye level. 

    IIRC ( this happened last October) the PCN stated we had 10 minutes grace and we then overstayed by 2 minutes.

    Try logging in on OPS' website to 'view all photos' because I want to see the sort of covert surveillance they'e using there - ANPR or CCTV. I can tell if you show the photos (cover the van's VRM of course).

    Could you also get some photos - go on foot - of the lack of signs, hidden camera, unlit dark corners or areas with no signs? You'll need them later on at claim stage. No worries!

    Yes, them not acknowledging your appeal is a breach of the BPA code of practice, so if necessary you can put this in any defence you draft. I have done this in my ongoing case.

    They switched to the IPC sometime in late 2024 I believe....will depend on when the PCN was issued if the complaint should go to IPC or BPA.  Of course those signs will almost 100% state BPA AOS on them so technically they've breached the signage requirement to state the ATA they are a member of if the ticket was issued after they switched to IPC.
