I am not sure that any of those points will stick but it's a valiant effort! Doesn't matter if it loses as you won't be paying.

I would just change the bit where you say they must show landowner authority with 'Britannia Parking' to 'Britannia Parking Group Ltd' (assuming that is the Ltd company named at the bottom of the sign inside the car park, which you didn't show us yet)?

It is important we look at the t&cs sign first. Can you get a readable photo? We'd be looking for how big the £100 is and which Britannia name is at the bottom (they have lost POPLA cases on that basis before).

I’ve uploaded the pictures i have of the t&c signs and Britannia parking group Ltd is named on the signs - same as the NtK and the size of the so called charge amount seems to be compliant. 

I probably need to provide a couple of photos to give context of the location of the signs, as it’s possible to park in the first few spaces without seeing a sign.

Breaking it all down into a couple of salient points though; they did not deliver the NtK in time (7 days late!) and I’ve asserted that an attempt was made to validate at the machine - if they follow their own CoP, it should at the very least result in a reduced charge.

Reading through some of the examples of rejected POPLA appeals, it amazes me how they get away with it when it’s spelt out so clearly by the appellant how their own CoP has been broken in their application of terms (and indeed legislation in many cases)

I’ve had my weekly visit to this car park again today and taken some more pictures. I’ve noticed that there is t&cs sign that is different in a reserved parking spot - I’ve never noticed this before as the parking spot its behind is usually occupied but this one has tariff info on it. I’ve uploaded these to the same submission pack folder.

Which is why you need to clearly state that you do not believe that the landowner authority is with the same legal entity and put them to strict proof. Do not just leave it as you had it.

DO NOT show POPLA any close ups of signs. They are just for us.

Hello, just to update this thread - I got an email from POPLA a couple of days ago indicating that Britannia Parking had decided to not answer the appeal and cancel the parking charge. No explanation was given. I’d just like to thank everybody on this forum who is taking the time to help people fight these unjust parking charges. Hopefully, sometime in the near future, the legislation will be changed and these shysters will crawl back under the rock whence they came.
