Moorside legal letter of claim petrol

Hey guys.

Apologies writing here, I just wanted to know if any one knows the law if petrol is put into your car and there is clear picture proof it WASNT by you, you can get taken to court and sided against.

basically, my husband who now doesn’t live with me and doesn’t use the car has been very unwell with MH issues and addiction. I gave him money to put into the car and he spent that money elsewhere and didn’t pay for the fuel. This happened on a few occasions until I received letters about it and then he’s not been allowed to fuel the car since. 

But where do I stand defending this? I can respond to the claim, I either dispute I owe it as they have evidence it wasn’t me but if they say it was my car can I begrudgingly pay just the fuel amount say ?£45 and get the other costs removed?

any advice or help would be appreciated

    You are not responsible for the theft and they cannot take you to court if there is clear evidence it was not you stealing the fuel. I would respond saying that the driver was your husband, you have since separated and he no longer lives at your address.

    Standard debt collector tactics, they don't care who pays, they just want the money.  It is quite simply covered under the theft act, there is no keeper liability as there is with some motoring offences.  If they have a picture of someone who is not you then they are on to a loser chasing you.

    Be assured, as others have said, there is no 'keeper liability' law about theft while someone happens to be in a car for which you are the keeper.
