In the way you describe it would be classed as a Contrived Tenancy.
Let's Be Careful Out There2 -
Renting from an ex partner
You can get universal credit housing costs to rent from an ex partner if you have a proper tenancy agreement.
You cannot claim housing benefit if either:
you lived as a couple in the home you now rent
you have a child together who is under 16 and lives with you

Only 'potentially' but probably not here, because if she used to joint own the house and is taken off the deeds in order to create a rent liability, that's going to be a contrived tenancy almost certainly.2 -
What exactly are you proposing?
Your wife would move out to live elsewhere and you remain in the marital home ?
Where do the children live?
What is the rent your wife would be paying to you?On what property?
Will there be a proper tenancy agreement ?0 -
I just hope the partner is obtaining their own independent advice. The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.1
