BW LOC


i received the attached LOC earlier this week and it’s the first letter we’ve had regarding the alleged contravention which was 3 years ago, we’ve had no PCN or letters from debt recovery firms at all. I’ve read the newbies and I think that my first course of action is to complain as this is the first I’ve heard about it but just wanted to make sure. Sorry if I’m wasting your time if this has been addressed in another thread but not very good at these things. My address hasn’t changed at all so not sure who they have been chasing.

Not receiving paperwork is no defence, its usually caused by people moving and not updating the DVLA promptly, causing paperwork to go to old addresses, very common mistake, but generally owner error ( registered keeper error ) , not their error1 -
My address hasn’t changed at allFor years? Most likely you heard nothing because you forgot to update the address in your V5C, maybe even before 2022. You must put that error right with the DVLA so check your V5C address now. Maybe it is wrong.Re the LoC, just use BW's portal and send the usual LBC / LoC response. There is only one and it really doesn't matter what you send, as long as you don't send offers of money!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Good Afternoon,
We write in response to your recent contact.
We act on behalf of our Client UK Car Park Management Limited.
Our Client’s claim is for the sum of £170.00 and is in relation to a parking contravention with the reference number at AT Car Park
The vehicle involved in the contravention, with registration number broke the terms and conditions of the car park by failing to pay for the duration of the stay.
Please see the PCN evidence attached.
Debt recovery costs are contractually agreed by the motorist when visiting the car park. They only apply when the opportunity to pay the parking charge has expired and the parking company has been forced to commence debt recovery activities. Such contractual costs are recognised by the courts as covering debt recovery activity between the expiry of the parking charge notice and the commencement of litigation, including pre-litigation correspondence.
The fees we charge our clients for our services are subject to VAT. However, these are separate and distinct from contractual debt recovery costs recoverable by our client from the motorist.
