It’s an online auction house. I just want advice on the above point not speculation as to who it could be lol0

Does the terms of sale state if the customer is to return goods in the event of them not being as described?
I understand you purchased online but would anyone have had the option of attending the auction in person? In the game of chess you can never let your adversary see your pieces0 -
"(4)The notice shall be in writing and shall be sent by post in a registered letter, or by the recorded delivery service."
See s12 and Part 2 of Schedule 1 of the Torts (Interference with Goods) Act 19770 -
Does this online auction house have a physical premises?
Get the car towed to it, leave it there, with the keys. Job done.0 -
Ramo9555 said:Thanks for clarifying, is my best option to sell it for scrap or at another auction? What happens if they come after me for the car in 6 months? I’ve already waited 3 months so I want to get rid of it or repair itselfI've used webuyanycar.com previously to sell a car with no MOT. I'd recommend them.Your auction company have not responded to you for 3 months. You can't be expected to store the car indefinitely and you shouldn't have to foot the bill for sending the car back to the auction house. If the auction company come after you then you can say the car needed to be sold to cover your fees for storing the car!1

Ramo9555 said:The T&Cs just state that I should contact the customer complaints team which I did and they were zero help. Nothing about returning the vehicle, probably as not many people are successful to dispute an auction car
Do you know if anyone can attend the auction OP?
If not them the CRA applies and you've rejected and been refunded which as you said makes you an involuntary bailee so you can sell the car for a fair price (I wouldn't scrap it, eBay auction maybe?)
If people can attend then only parts of the CRA apply and I'm not sure what you fall back on (Sale of Goods Act? CCRs?)
If you have space to stick it in a garage or under a tarp it'll probably be worth a small fortune in 40 years time!In the game of chess you can never let your adversary see your pieces0 -
I don’t want to pay for a haulage company again. As per my post I just spent £800 to get car delivered which I’ve been unable to recover plus I have an eyesore of a car in my driveway for the past 3 months. I just want to keep myself right so they can’t come after me legally if I repair the car with my own money or if I sell the car on. I won’t be paying for the car to be returned, I’ve already lost money on this and asked them to collect it 3 months ago0
