Right to Buy discount affected with cost floor rule before new regulations

I applied under the govt Right to Buy for a flat before the new rules of 21st Nov 2024 came into effect. Mine is a new built flat built after 2012 and asks for 15 years of “cost floor” to get maximum old discount and I have completed only 9 years of cost floor years.

The new regulations of 21st November 2024 never gave council tenants falling under the cost floor rule, sufficient time to look at alternatives for example to swap and move to a different council property that would not require “cost floor years”. The new regulations never gave enough time to look at alternatives due to “cost floor years” affecting our discounts. The new law does not anticipate those council tenants patiently accumulating their “cost floor years” but rather brings a new law without any due consideration to these exceptional cases who will be disadvantaged. The new law kicked in too quicky to allow time for cases like mine. I have been waiting from this assurance from govt and therefore never applied to rent another council property thinking that I will get 50% discount along with accumulated % of discount after my 15 years in the new built flat.

Since I applied before 21 Nov 2024, I strongly feel my right to buy under the previous regulations and old maximum discounts should be protected so I avail the max discount when my “cost floor” floor reaches 15 years after another 6 years.

The govt consultation on reforming the right to buy began on 20th November 2024 and ended on 15th January 2025. This is very short period during the busy festive season for any consultation to gather evidence.

    Since I applied before 20 Nov 2024 my RTB application I feel should be disposed/resolved based on the old previous discounts by adjusting the percentages and number of cost floor test years.

     You might feel that but thats not what the rules say,
