BW Legal - Parking Fines

Hi there, I have received a letter today for my son, its claiming parking fines totallying £1530.00! He lives in America, however, during Jan - May 22, (when the tickets were issued), he was in the UK. I know he got a few tickets and they were all paid off, but to get a letter out of the blue 4 years after the fact was a bit of a shock to say the least. I am after advice: Do I ignor the letters, (afterall, he doesnt live here, nor in the UK anymore?), or do I respond to them?
Any help would be appreciated.

    Letter of Claim? Or the letter before it?

    Son URGENTLY emails BW Legal and the Parking firm's DPO email (see their privacy page) telling them both that:

    - his permanent domicile is in America and his address is FULL US ADDRESS, and proof of this in his name is attached (utility bill?);

    - the UK address must be erased because his mother/father live there and were intimidated by the unwanted threat they received. He does not live there and is permanently living and working/studying? outside of the jurisdiction of the UK Courts;

    - As such, BW Legal must close the file and return it to their client with information about the data rectification (all parties must only hold the US address for service now);

    - Should BW Legal continue to pursue this matter by any contact whatsoever, despite knowing that the proposed Defendant lives outside of the UK and that the people living at the UK address are severely distressed by their letters and are not the alleged debtor, then Mr Corrin Brown, Legal Director/Head of Legal Services at BW Legal will be immediately reported to the Solicitors Regulatory Authority with the appropriate evidence of failing to abide by the STaRs.

    Thanks for this. I am forming my response now. I dont want to give them his US address though. Is that essential? I dont want to say where he lives or give them any help whatsoever - or is that just something that I will have to do?

    If the letter is in your own name as the Registered Keeper,  you MUST give them his name and address as the driver,  to transfer liability,  BEFORE they issue a court claim against you using MCOL  ( too late once a court claim is started  )

    I dont see how you have a choice   ( unless the letters were addressed to him and not to you  ?  )

    Infrm the parking company and also the lawyers too, so both parties,  ASAP 

    Which parking company   ?

    Its not in my name, its in his. Its his car and he was the registered keeper. UK Car Park Management Limited.

    Then it's nothing to do with you , so no response needed by you,  you are effectively a stranger to the case, your address is being used because he hasn't given them his foreign address for the service of papers 

    But if I were you I would get HIM to email the DPO at UKCPM and give them his current address in the USA, attaching copies of 2 recent utility bills or similar,  as proof, suitably redacted of course , job done

    If he doesn't do as above, he might find if he does come back to the UK a CCJ filed against him by default!

    1. You are not responding. He must.  It's not your case. You can't reply to it. Don't get this wrong because he'll then get a Claim Form then (potentially) bailiffs coming to your house by the Summer. My advice completely stops all that.

    2. Yes it is essential and I think you've missed the point: him giving his address for service as in the USA means he can't be sued!

    He (not you) must follow my advice to the letter this week. It is urgent.
