We have been trying to claim winter fuel payments only to be told we can’t claim it as our home is not on the EPC register we had our home surveyed by our housing association but they tell us that they have no legal demand to put the results on the EPC register has anyone else had this problem and how did you sort it out

Have you checked that what you were told about your home needing an EPC to be eligible for Winter Fuel Payments is correct ?
I have looked at the Government website and nothing is stated about EPC requirement.
Where do you live ? England/Wales, Scotland or Northern Ireland. The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -
The reference to EPC usually comes from trying to claim the £150 Warm Home Discount. Which is also mostly incorrect but not sometimes not -
Eligibility for the WHD in England and Wales is based on claiming a qualifying benefit, and a calculation about whether your home is deemed to have high energy costs. That calculation is based on three pieces of information: age, type (flat / semi-detached / etc.) and size (floor area), which the government dept is supposed to source from the VOA. If any of those three pieces of information are missing, an EPC is an alternative source, or if just one piece is missing, they can impute it from surrounding properties where appropriate.
So if this is about the WHD, that's the why behind it. As for sorting it out, unfortunately I don't know. Do you know the age and floor area of your home? If so, and you tell us the type, it can be looked up to see where your property falls in the energy calculation to see if it's worth pursuing at all (because if it definitely wouldn't qualify, then right now it would be pointless).
However if this is about the Winter Fuel Payment, specifically for pensioners claiming a qualifying means-tested benefit, then I have no idea what could be going on because the only criteria are being of pension age by a certain date (sometime in September last year, IIRC) and claiming a qualifying benefit like UC or PC. Nothing at all to do with the characteristics of your home.0
