Received a letter from Moorside Legal, who are representing Alliance Parking. I have drafted a reply and would appreciate any advice or confirmation on whether my response is appropriate.

REFERENCE: 

Dear Moorside Legal,

I am writing about your letter dated 7 April 2025 regarding the alleged parking charge associated with vehicle registration *******. At the time of the incident, I was the registered keeper of the vehicle; however, I was not the individual operating the vehicle.

I kindly request that all future correspondence concerning this matter be directed to your client, Alliance Parking UK Ltd. Additionally, I previously submitted a Subject Access Request to Alliance Parking UK Ltd through your office to obtain all pertinent information related to this alleged charge, and I am currently awaiting a response.

For the avoidance of any misunderstanding, I am unable to disclose the identity of the driver at this time.

I express my concern regarding the contents of your correspondence and the potential for unnecessary legal action. It is imperative to note that pursuing action against an individual who was not the driver may constitute a misdirected effort.

Should your client continue to process my personal data without a legitimate basis and initiate unwarranted legal proceedings against me as the registered keeper, despite my non-involvement as the driver, I reserve the right to file a Part 20 counterclaim for damages. This may encompass distress arising from potential violations of the Data Protection Act 2018 and/or the Protection from Harassment Act 1997.

I expect that Alliance Parking UK Ltd will adhere to legal requirements and the forthcoming statutory Code of Practice by ensuring that Notices of Parking Charge are issued by law and that they engage fairly with motorists.

I request confirmation that you will cease any direct communication with me regarding this issue and will redirect all further inquiries to the appropriate party.

    must point out that you still haven't clearly
    explained why you believe it is pointless or
    provided any genuine advice on what I
    could do better.

    I suggest reading other Moorside threads. They only started last year so there are fewer threads than other solicitors. Much easier to search and find. Read & learn from others who are further ahead than you.

    Bottom line: you'll get a court claim anyway and that will be easy to defend. It's what you want.
