Hi there
So far, I've had a 100% success ratio of DCB dropping their claim a couple of days before court, and I don't want that to change!
Ocean Parking have issued a parking fine, for a car that had broken down, where we have provided evidence the AA attended to repair it. The appeal has been rejected - surprise surprise.
It occurred at a Manchester metro car park, where over night parking is only available on Friday and Saturday night, but this occurred on a Thursday night.
I've already beaten them once at POPLA stage maybe a couple of years ago, however they seem to have moved to IAS which is hardly surprising, given they are a kangaroo court.
This thread is to track progress, to ask the rules around broken down vehicles (I've googled it and can't find anything conclusive), and check if I'm correct in saying the next step is to wait until LBC etc?

Have a look at the court case Jopson v Homeguard where the judge decided ‘dealing with some small vicissitude of short duration’ including breakdowns is not parking.5

I'd try a complaint to the landowner.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

That seems to relate to a brief stop rather than one slightly extended like in this case, but I do appreciate the suggestion!1 -
