Letter Before Claim from Elms Legal

Options
Hello,

At the end of March this year I received a Final Reminder from Excel Parking for an event at the end of January despite not having received any letters prior. I sent them a SAR and they sent A Notice to Keeper they purport to have sent along with some photos. Shortly after receiving the response to the SAR Elms Legal have sent me a letter before claim for the same.

The vehicle was mine but was written off after another driver collided with it while it was parked last year. Their insurance company bought the car from me and later sold it at auction. Upon receiving the final reminder I contacted the DVLA who told me the keeper details had never been updated. This has now been rectified and they confirmed another ticket had been issued from a different company (SIP Parking Limited) which I am now also in receipt of.

I find the wording amusing, it seems to imply the vehicle itself breached the terms and conditions so they issued it with a notice. I didn't know inanimate objects had gained sentience and can enter into contracts!

I'm drafting a response now based on a search of recent posts. Does anyone know what email address to send it to? Should I include documentary evidence that the vehicle was not mine at the time? Is there anything I'd be advised to include in addition?

Thanks in advance  :)

    Sorry no. Search the forum.

    Definitely.

And for the SIP one because they sue too.

I sent ELMS the description I gave above about the write off and said that I hoped this settles the matter but if not, then used the template letter from the FAQ. They responded saying they had sent it over to Excel and would be back in touch in due course.

I also sent the same explanation plus evidence to SIP. They asked for the registered address for service of the insurance company that took the car. It's public info and was in the evidence I'd attached anyway so I obliged and asked for confirmation that the matter was closed insofar as it relates to me. I haven't heard back yet.

SIP say they confirm the PCN, "has been transferred". Presumably that means I no longer need to be concerned with it? Or seek I ask for more specific wording to ensure it won't ever come back to me?

Still waiting to hear from Excel/ELMS Legal.
