Court Claim No Stopping Leeds Armouries

Hello 
Im looking for help to defend a court claim received for a PCN via a Notice To Keeper from Moorside legal on behalf of UKCPS for No Stopping outside Leeds Armouries.
Subsequent photographs from UKCPS show car stopped for 38seconds at a zebra crossing within the "no stopping zone".  with either a person stood as though waiting to cross or a photo showing a another person crossing.
Appeal was rejected as UKCPS claim the passenger door is opened during this period at the zebra crossing.
It was 1230am, dark, forbidding signs are not lit, there are yellow lines not red. 

Local MP got involved by writing to UKCPS, who declined to drop charge on basis passenger car door  opened.
Ive written to Royal Armouries to complain and ask them to drop - awaiting response.
Ive written to DVLA to ask if No Stopping is a legal reason for UKCPS to ask for and DVLA to provide keeper details as part of PoFA, they have said they will investigate.

Any other help or advice appreciated.

    So UKCPS via Moorside Legal,  issue date 30 april

    Get the AOS done on MCOL first,  as described in the newbies sticky thread in announcements,  then use the template defence in the thread by coupon mad,  again in announcements near the top of the forum 

    Adapt paragraphs 2 & 3 as required,  no stories or explanations,  stick to the template 

    Edit 

    If using the alternative defence template, ( Parking Eye or Moorside   ) the paragraphs are around 5 & 6

    So you stopped at a zebra crossing? At lines painted by the landowner that indicate you must stop if a pedestrian is crossing?

    Whether you let a passenger out at the same time or ate a pizza whilst stopped is of no relevance and no mention of a charge being payable for either events is mentioned on the signage.

    What a ridiculous claim. One for the parliamentary debate the other day "my constituent was "fined" for stopping at a zebra crossing when a pedestrian was on it."

    You should also look for some of the airport no stopping tickets/challenges.
    Ona side note have you contacted the landowner/Leeds armouries, and instructed them to tell their agents to discontinue?

    Stopping is not parking, and it would appear that they have obtained your details on the grounds that you were parked.
     I would be inclined to do the following:
    Follow the advice from Gr1pr
     Contact Leeds armouries and tell them to instruct their agents, for whose actions they are jointly and severally liable for, to discontinue this case, inform them that you will be expectiing them to pay you for your time and expenses wasted on this at £19/hour or part thereof
    Keep a record of how long you are spending on this
    Contact your local media

    If the case is dropped, and or it goes to court and you win then do not let leeds armouries off the hook, state that you want them to pay you for your time wasted - that is as long as its leeds armouries land

  • With regards to the court claim paperwork and the preceding bullying letters from debt collectors etc they have mis spelt my first name missing letters out. Is that sufficient to make it non valid or Do I correct that on the court return form? Thanks

    You correct it in the AOS, and in your defence etc

    But 

    Do get out your V5c log book and check your details,  sometimes that is where the errors occur,  letting the dvla know if incorrect

    As a resident of Leeds I refuse to go anywhere near Armouries to drop off,  if ever there was a honey trap that is it.  I drop off on the street and tell passengers to walk.

    There is a marked drop off area further around the access road which is large enough for about 3 vehicles, but the only sign is a wierd roundabout sign inside a triangle indicating a drop off area, this is immediately above a sign saying no stopping!

    Imagine an event where there are 1500 people attending all being dropped off and picked up when it finishes.  Kerching.

    The facts on a Moorside case don't go in as paragraph 3 (fully explained when you read the Template Defence thread first post link to the starting paragraphs in Moorside cases).

    By the way, that photo shows an example of all that is wrong with PPC World, doesn't it, including the fact the IPC allowed this:

    - no stopping sign in a place where that rule is wholly inappropriate

    - yellow lines, not reds (errrrr... so it's not a 'no stopping zone' at all then).

    - CCTV trained on a zebra crossing, catching people for the heinous crime of 'stopping at a zebra crossing' for mere seconds.

    Interesting that the KADOE data release reasons are so limited (stopping isn't mentioned), yet they release data to PPCs with no questions asked at all.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
