Damage caused by Openreach

Then you can’t “go after Openreach” - they have no liability.Richard_Wetenhall said:
Unlikely. It stands on the Parish Council allotments. I’ve never seen any work done on it and I’ve been here 25 years. That said, I have no interest in going after the Parish Council.littleboo said:Hard to see why Openreach would be liable, they didn't cause the issue. Has the tree been properly maintained?I will tell Openreach to remove their other redundant wires and see what happens.
If the tree is on Parish grounds and they are responsible for it, then they would be the responsible party IF the branch fell due to lack of their maintenance0 -
I accept what’s said. Helpful as it stops me taking legals against Openreach. What gets my goat is that I asked for the line to be removed (no longer in service and won’t be again). They refused and claimed they had a right to retain it. Then this happens and they deny any responsibility. So something I don’t want and had asked to be removed causes £1100 of damage and it’s my responsibility?0

For your (and Openreach's) rights and responsibilities see the Electronic Communications Code...Richard_Wetenhall said:I accept what’s said. I presume Openreach take the view that the next owner of the property may still want the connection.0
