Could anyone please offer me any advice regarding the following…
My unattended car was hit by a third party 2 years ago
It was repaired and all settled…or so I thought
My insurers however did not recover the costs and passed it to a solicitors

I have now received a court date in London - to be there at 9.30am
This is 3 hours away from my home address and I absolutely cannot even consider making the journey alone not to mention affording it - I am completely clueless about getting to London or about London itself
Furthermore, I could not travel the night before due to dependants

I have nothing to offer the hearing as I did not witness the accident

It is impossible to contact the solicitors by phone to discuss and they do not reply to my emails

Has anyone else been in a similar situation?
Any direction or advice would be most appreciated

Thank you in advance

If you are not getting a response from the solicitor ring the insurer as they are working for them

    Recovery of the insurers outlay

In practical terms it's likely to be OP's insurer -v- the Third Party Insurer (TPI), assuming no indemnity issues. In actuality it's often issued as OP -v- TP as the OP' insurers losses are the OP's losses.

Speak to your insurers, they'll be able to advise what is going on in terms of why it's going to court. Could be a problem with indemnity of the third party, denial of liability or dispute on quantum. It could simply be the TPI being very slow which effectively becomes a quantum dispute.

Did you have any out of pocket expenses? Like your excess? Did you get that back?

If the vehicle was parked and unattended how was the third party identified?

Depending on what the dispute is about may dictate how likely you are going to need to be there or if there are other options like written statements and/or video calls. Depending on how your insurers manage their solicitors it may be they can discuss these things with you or it may be you need to speak to the solicitors.

    Thank you

No, there were no out of pocket expenses and I didn’t pay an excess

The third party was a Tradesman working at a neighbours and left his name and contact details, vehicle registration number etc with them. The third party admitted full
liability and all details were passed to my insurers

I’ll try to speak with the insurance company

    Thank you again
