Extension query

Next door have put in application for planning again and now looking to do 1.4m x 3.5m rear extension and front extension wrap round.

They were previously rejected as they put in for 4m x 5m rear and were told it was over dominant and not allowed a 2.3m x 5m front wrap around either.

After seeing the new application it's quite a change at the rear from 4 to 1.4. I know for permitted development that requires no planning they can go to 3m. The only reason they have gone down the planning route is because of the front and side extension. 

Is it possible that whilst the plan says 1.4m at the back  and if the whole application is approved...cant see it being rejected now they have made the changes....they go ahead and build out to 3m at the back because they can then submit under permitteed. Or because they have put in for planning permission they have to stick to what's approved and csnt then out in to change rear extension sion to be 3m under permitted

I think the answer is they have to stick with 1.4m but if they want to go to 3m they have to submit for permitted? 

Sorry I am so new to all of this a d my friends have said its strange they aren't just doing full 3m and think they are being sneaky ( we don't have a good relationship after they tried to grab some of my land).

    Essentially, the total size of all extensions, including the new one, must comply with the overall permitted

    If they get full consent for a 1.4m rear extension then that is what they have to build - they cannot mix and match with PD to make it larger.  If there is a concern about overdevelopment or an overbearing proposal the council will typically remove the relevant permitted development rights to make sure this can't be done.  If you are concerned then you could ask the planners if they intend to remove PD rights which would prevent the extension going out any further than 1.4m.

    If they wanted a larger extension then it seems odd that they didn't add the larger extension at the rear to the max of PD, then apply for consent for the front and side extensions as a separate project.  That may support your fears that they plan to build more than shown on the plans once they have the consent.

    I don't think there is much I can object now as it seems like it meets all the concerns from the previous application thag was rejected. 1.4m isn't really that overbearing for my kitchen window as much as 3m will be.

    I'll definitely speak to the planning officer and see if they intend to remove PD rights I think that would really help actually because then of they do it removes any possibility. 

    Do you think that is something they will likely agree to?

    It just depends whether they think there is a risk of PD rights being used to go further than what is consented.

    Your role is just to make sure the planner is thinking about it when they do their report and decision letter.
