SMART PARKING NOW USING POFA. ADVICE PLEASE.

SP are now using POFA wording on their PCNs. I've got several for double dipping. Waiting to hear back from client landowner who has cancelled them before. In the meanwhile should I adjust the standard template appeal to include a SAR for all ANPR entry and exit images they have of my car for those days or do a SAR separately? This is happening to lots of people in my local area and it's becoming a bigger issue. Advice gratefully received.

    Nothing new. Not now.

    Discussed lots of times before in 2025 and we always win at POPLA with the 'no landowner authority' one-liner you no doubt saw, when you read other recent 2025 Smart POPLA threads before posting.

    Just use the standard template but you might consider adding:

    "On the material date my vehicle made two separate visits to this location, and you appear to have matched the first entry with the second exit when in fact my vehicle was not parked for the time you claim.  You are put to strict proof of the contrary.

    It is my belief that you have obtained my personal data without 'reasonable cause' and as a consequence you are in breach of the DVLA KADOE contract. By continuing to store and process this data you are also in breach of the Data Protection Act 2018. 

    Should you fail to cancel this charge I will consider issuing a Letter of Claim for the sum of not less than £250 which is at the lower end of the scale for similar breaches."

    If you have evidence of the car's whereabouts in the time they claim it was parked then use that too.
