Evri delivered to the wrong address, AliExpress won't refund

    I finally gave up on either AliExpress or Evri actually doing anything useful. Nothing that Evri provided me as evidence that the item is lost was sufficient for AliExpress so I opened a PayPal case. I chose to speak to them on the phone because I have so much correspondence, I didn't know where to start but it's the last throw of the dice and regardless how it goes, given AliExpress' behaviour, I'm going to do my best to avoid shopping on there.

    I had this exact same problem when a eBay parcel was delivered by the then new Amazon delivery service and sent to the wrong address. I was in my house when they claimed they delivered, looked outside and there was no parcel! I asked all of my neighbours on the WhatsApp group in case that dropped it at the wrong house. I then wrote to the sellaler that said it was "Mark delivered" and as far as they concerned that was the the end of it. I then went to the Amazon delivery site with the tracking details that simply marked it as "delivered". I couldn't get any further details because' they required a login from the customer, and I was not the customer, my seller was. I then called eBay customer service who also agreed with the seller, that once the item at being marked "delivered" that was the end. He then told me it was up to me to find further evidence that it had been delivered wrongly, and I told him that I couldn't get access to the evidence but that the seller could easily access it. He just argued with me that I could get that evidence. But the recipient can't for oblivious reasons. I just lost the curtains I bought. I did post the whole discussion here but it was deleted shortly after by MSE

    I've had the same problem with eBay and Amazon but I have, after a great deal of fuss, either been able to get my point across or somehow located the missing item. The additional frustration here is that the seller is using AliExpress as a platform and I imagine that to them, British consumer rights are some distance below Chinese human rights.

    As far as the PayPal dispute goes, AliExpress have responded to my claim but I cannot see what they have said beyond that they added tracking information which I had already provided. I think that PayPal will make a decision on or shortly after 28th May.

    Unbelievably, PayPal have rejected my claim!

    I posted photos of my house and shed showing that they clearly do not match the delivery photo and merely state that the item was 'delivered'.

    This phenomenon is clearly a problem for many people and there does not seem to be any remedy in consumer law as far as I am aware. I'd love to know what any experts in consumer law have to say on the matter.

    Okay, well I was pretty enraged and there was nothing going to stop me phoning PayPal and to their credit, they said that on reviewing the evidence (I think they actually mean, 'on viewing the evidence'), they have changed their mind and are refunding me.

    The case status currently says 'under review' and I haven't actually got my money back just yet but I'm glad I made the phone call.
