Hi all,
I posted a few weeks ago and you were really helpful so hoping for some more advice please.
I was sent a PCN a year ago which I’m currently still fighting. At the moment I’m waiting for a reply to my subject access request after receiving a letter before claim from Gladstone Solicitors.
However, I’ve noticed tonight (can’t believe it’s taken me this long!) that the photos on the PCN showing my car entering and ‘exiting’ the car park are identical photos! Both photos are of my car leaving the car park and facing the same direction. The gate and even down to the stones on the floor are identical. Yet both photos show different times captured by the camera! (11 minutes apart, apparently. I’m being charged £170 for 11 minutes on the land after taking a wrong turn and then stopping to ask for directions).
So my question to you is whether this shows their evidence is invalid? If they take me to court, could it be thrown out just based on this? If so, I’m wondering what you would suggest my next move is. Shall I wait to hear from Gladstone solicitors again (I have sent my reply to the letter before claim in the post), wait to see if LPS supply me with the photographic evidence I’ve requested, or shall I contact them again straight away? If I contact them I’m not sure how you would suggest to word this to get them to see that the photographic evidence is not correct and doesn’t prove anything. It’s clear on the PCN they only have the front of my car and front registration plate.

It’s worrying to think that these times could be made up! If I could post a photo here I would show you what I mean.
