Company PCN parking fine


I paid for parking on the machine in the carpark.
I overstayed the time by longer than any grace period.
13:48 - 16:14 and I had paid for 2 hours.
I'm sure there are some who will consider the following an excuse, but I have ADHD and was attending an appointment with a Psychologist and I got the timings muddled up. I had arrived way too early because I over plan (to counter the ADHD!) and my appointment was 3pm - 4pm, so I really had got it completely wrong and must have been thinking it was 14:48 in my head.
I had not used an NCP carpark before and did not have the app, but noted when I first went to pay that I could download it and extent the time if needed.
When I knew that I was going to overstay I downloaded the app, registered and tried to create a new time period (I could not simply extend as I had not purchased parking on the app).
It would not work - no idea why, but the app just wasn't working.
I have a screenshot of the date I downloaded the app to show that I had intended to address the overstaying issue.
So whilst out and about there was nothing more I could do.
I got back to the carpark and I couldn't get another ticket retrospectively to cover the and saw a sign saying something about paying after you have stayed.
When I got home I attempted to do this.
It wouldn't let me on the app because it said that that option was not available at that carpark.
I am going to drive over to the carpark and take a photo of the sign, because I'm fairly sure it was not clear that I could not pay later for that site.
I then sent them a message to explain that I wanted to pay but couldn't with all my details.
They have never responded.
Today I got the letter.
Rather, my company got the letter - leased car through the company. They do not have my name. Could anyone advise please?
It says:
Payment for the Parking Charge (PCN)ZP******** is due.
Please pay the amount of £60 now.
Parking Contravention: Parked longer than the time paid for
A Parking Charge was issued when a vehicle you have been named as hiring was parked at Lincoln Central on 16/04/2025 at 16:14.
The vehicle breached the following condition: Parked longer than the time paid for. Signs clearly displayed in the car park state that breaching the terms of parking may result in a charge.
We have received your details following a transfer of liability from the hire company naming you as the hirer of the vehicle at the time of contravention. If you were not the hirer of the vehicle at the time it was parked, or if the vehicle was stolen before the charge was issued, please, let us know.

Seems to me that whoever the Registered Keeper is, they named you or your company as the hirer, hence why the new letter arrived to the hirer
The contravention ( its not a fine , its an invoice ) will be insufficient payment for the period that the vehicle was onsite
I am afraid that excuses etc wont help you to fight it, but the laws will
The chances are that the Claimant Parking company, NCP, failed to comply with Pofa 2012, the law that could make the hirer liable for the invoice from NCP, usually because they dont include a copy of the hire agreement
Study the first post in the newbies sticky thread in announcements near the top of the forum, checking the bottom section that specifically deals with hire or company vehicles. Follow the advice given in there by member Edna Basher
No blabbing about who was driving, not to anyone, because you should prevail using the lack of Pofa2012 compliance as your get out2 -

I'm not sure I understand - are you saying that because it's a leased company car there is no keeper liability?

To confirm - ALD Automotive have written to the Company (my ltd company) advising that they have transferred liability to the Company as the Hirer.
NCP are BPA-accredited, and have sent a parking charge to hirer (my company).
No-one knows who was driving.
The letter to submit - online - is:
"Dear Sir,
Parking Charge Notice [0123456789]: Vehicle Registration [AA11ABC]
I refer to the above-detailed Parking Charge Notice (“PCN”) issued to me by Highview Parking Ltd (“Highview”) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (“POFA”) and I write to formally challenge the validity of this PCN.
You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Highview’s Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.
Given that Highview has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

Please know that I didn't just grab the first thing that I found because you have been kind enough to help and I don't want to waste anyone's time.
I spend a good hour reading through everything I could find and there are 4 links on the Newbies page by Edna Basher in the Company, Lease or Hire Car area.
The only one that I could see that made mention of ABC in any way was the one I have pasted. I didn't know what you meant by 'the blue writing appeal,' but assumed this:
"Re PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner."
So I ignored that, and looked instead at:
"* COMPANY, LEASE OR HIRE CARS ANYWHERE IN THE UK
With a company/leased or hire car, if you get a windscreen ticket and cannot get it cancelled by the landowner (PLAN A above), appeal within 2 weeks, well before day 21 to hook the PPC in your direction to stop them getting the keeper's details from the DVLA.
You should also warn the owner/keeper (Fleet Manager) not to pay. If the hire/lease firm gets a postal PCN and names you as the hirer, that is a good thing as it removes them from the loop and then you can follow the above advice as appropriate to your case.
Here are examples of a successful appeal for company cars/lease/hire/rental cases, where the PPC has (pretty much ALWAYS!) failed to send the required documents to the hirer with the postal Notice:

I thought that the last link looked the most relevant, but cannot see a reference to "See the leased vehicle 'ABC Company' appeal" anywhere but the 2nd link mentioning ABC but not company. I can see further into the final thread about Topher company, you made the same suggestion about ABC company.
I did a search for ABC company and a search on all posts created by Edna Basher. I can see someone else had the same query.
As you do know the post to which you're referring and I do not, could you let me know where it is?
I'm not ungrateful, but just telling me 'no, that's not the one I said,' would take as long as sending a link if you know exactly where to look and I don't.

"Further to your appeal received on 09/05/2025 regarding the above Parking Charge.Your appeal has been reviewed and has been considered in conjunction with the evidence gathered by ourAutomatic Number Plate Recognition cameras, which record your entry and exit times. Having considered thecontent of your letter this notice has been cancelled.Please ensure you take into account the displayed terms and conditions of parking, to ensure you do not receiveany further Parking Charges.Kind RegardsAppeals DepartmentNational Car Parks Ltd"
