Thanks, @Coupon-mad I’ve taken your feedback on board and added that I’m unsure who the driver was. I'm planning to send it off today unless there’s anything else you think I should include.
Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. The Defendant does not accept that a contravention occurred on 27/11/2019, as alleged. Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The car park in question is a residents-only car park at that time the Defendant is the registered keeper of the vehicle in question. The alleged contravention occurred over five years ago, and due to the passage of time, the Defendant cannot now say with certainty who was driving on the specific date. At the material time, the Defendant resided at the premises and held a valid parking permit issued as part of the tenancy agreement. The Defendant's partner was also a named driver on the insurance policy and had equal access to the vehicle. As such, either party may have parked the car that day. In any event, the vehicle was parked by someone with full permission and legal right to do so, in accordance with the tenancy and permit scheme in place. The Defendant maintains that the Claimant has not established a breach of any clear or prominently displayed terms and that the parking was authorised. The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever. The Claimant is put to strict proof of all of their allegations.
