DCB Legal and Euro Car Parks May 2023 - Court Claim form received

thought I would update where the case is at

I followed the advice on the forum

I had the mediation phone session with the court officer back in November

He was very empathetic and the phone conference was pretty straightforward. They made an offer of a lower sum but I did not accept, as I dont owe them anything. He said I would get more contacts from DCB Legal

The case has been allocated to my local court for mid March

DBC Legal have e mailed and asked for £60 to settle the case to which I have not responded.

The Claimant deadline is 13th Feb to pay the court fee.

I await further developments

You don't await anything if you have a hearing order. It orders you to do something - WS and evidence in February-ish. As expected.

thanks for the quick response. I understood the advice on the forum was to complete a Witness Statement et al once you have seen the Claimants WS, time permitting. I am working on a draft, so its ready to go, so the deadline wont be missed.

Incorrect, the deadline for the WS is usually exactly the same time and date, so your understanding is only an idea if they send you their WS early, but always subject to the instructions on the court order, so read it again, because different courts and judges can set different deadlines , Look for

the Deadline for the WS stage

The deadline for the hearing fee payment by the claimant

The pencilled in hearing date and time

Plus check your email inbox and spam folders for their N279 discontinuation document too, extremely likely due to their recent offer, because that is the point when the hearing is vacated, or if they fail to pay the hearing fee by that deadline

the Deadline for the WS stage -

must be delivered to both parties and the court copies of all documents on which that party intends to rely at the hearing "no later than 14 days before the hearing" , "these should include the letter making the claim and any reply"

that would be by my calculation the 26 Feb, at the latest so giving 14 clear days (no ref to working days)

The deadline for the hearing fee payment by the claimant - 13th Feb 4pm

The pencilled in hearing date and time - 13th March 10am

I will keep any eye out for N279

Oh good.

They won't pay that hearing fee.

They'll discontinue within the next fortnight! Show us the NoD when it comes attached to an email, as we will need to see the NoD to count your success, when you get there.

Exactly, 3 crucial dates, starting with the put up or shut up hearing fee deadline, earlier than the rest for good reason, no payment, no hearing, making the rest meaningless

Pleased to say I got the notice of discontinuance N279 from DCB Legal today

I would like to say a real big thank you to the contributors on this forum for all the support, guidance and information. When your at the receiving end of all these threatening letters, its so helpful having someone who can put it all into context and show you the way to take them on. Really appreciated it.
