Marks and Spencer -2nd reductions Question

I was in my local M&s today and they had marked down their sale items again , fantastic I thought. I got some goodies and went off to the cash till only to be told that " all SALE items cannot be returned". I thought never mind , I will go with it and bought my stuff. Had there been a problem (there wasnt) eg zip broken or something similar, surely you would still be able to return ? I am just puzzled by this new policy and wonder if Marks are clamping down for a reason ???

It is illegal for M&S, or any shop, to say 'No Returns'. However, these shops get round this by saying 'This does not affect your Statutory Rights' in very small print.
Not everyone actually knows what these rights are
Sales of Goods Act:
All items must-
1)As described
2) Fit for Particular Purpose
3) Satisfactory quality
If any of these are broken then you are entitled to a remedy because the seller is in breach of contract:
1) Refund
2) Replacement
3) Repair
When you buy something at a shop (M&S) and none of the 3 are broken (nothing wrong with the item) then the shop doesn't have to give you a refund. That is just done for customer relations. That is what M&S means by 'No Refunds' - if you change your mind then they say 'sorry, bye'.
When an item is faulty at the shop (zip missing) and you point this out and they usually give a 10% discount or something, this has to be stated (receipt) so you can't return it for that issue because they have already told you and you have accepted it.

In my local M&S branch, they quite often have a rail of clothes that are seriously reduced (maybe have been bought in a different store and returned there or the last item of a range).
They mark the barcode with an 'S' and there is always a prominent notice on the rail saying that goods cannot be returned but statutory rights are not affected.
As SirMimic says, if there is nothing wrong with the item, you can't return them but if they are faulty then you can.
I've had some great bargains.

i bought some school skirts in there today ready for next sept £7 reduced to £2 so i bought 4, the lady mentioned when i paid they couldn't be returned too. not that i'm planning too it was a total bargain.Other women want a boob job. Honey the only silicone i'm interested in is on a 12 cup muffin tray, preferably shaped like little hearts0

I was told the same today when I bought something that had been marked down further. I assume it is just for sale items which have been marked a second time.
If it is faulty etc... then you should still be entitled to a refund.0
