CCJ


Hi, first time posting here, and I am hoping you can give me some advice.
This is regarding a parking charge pursued by DCB Legal and I've been following advice from this forum.
I received a claim form dated 11 March 2025. Acknowledged the service of a claim and submitted via MCOL on the 24 March
Made a note to reply by 23rd April - and submitted my response on 15 April and received an auto acknowledgement back.
Conscious now after re-reading posts that I have initially mis-read and that I submitted the defence late - believing it was 30 days from submitting the acknowledgement, not 30 days from the claim date itself. Damn it, so frustrated with myself for overlooking this when thinking I was being organised!
Found out this morning via a notification on my credit score that a CCJ has been applied to my credit file. I have not yet received any further information from the court regarding this.
Any help or advice on what steps I should/can take next would be greatly appreciated.

It'll cost you £313 to attempt to set it aside I'm afraid. And no guarantees because you don't really have an excuse.Paying the clowns at DCB Legal would mark it as satisfied, which isn't a disaster, especially if you add a notice of correction to you credit file that it was from a private parking company and misunderstood the court timings for filing a defence

Not a problem for things like mobile phone contracts, but it depends if you are planning to apply for a mortgage in the next few years...0 -
Actually, with that timeline, wouldn't paying it now mean it will be marked as settled and should be removed from any credit reports.1

I received an auto reply/acknowledgement back from Claimresponses.cnbc@ after I sent my defence on the 15th1

As a side note, I've just opened my mail from yesterday 26/04/25 to receive a letter from HM Courts and Tribunal Service. This details that payment needs to be made by 22nd April, obviously the date I now know the CCJ was applied from looking at my credit report.
I can only assume my post is not particularly prompt, as surely I should have received this well before the 22nd to give me time to respond or even be aware of this happening/moving on to the next stage? Additionally I recall the initial claim form arriving 5-6 days after the claim date.0 -
If I were you I would concentrate on getting the false CCJ set aside ASAP, starting tomorrow , not red tape and minutia , study the 3 cases I gave you to look at
The claim form service date is always 5 days after the issue date, to allow for its arrival with you, everyones is, nothing to see there, prompt AOS submission puts the deadline date at 33 days after the issue date, 28 days after the service date, same deadline date
13h of April was deadline date , so you emailed it 2 days late, the CNBC dragged their feet logging it and the lawyers pulled the trigger a week later ( which parking company is involved here ? )

Do you understand that the 2020 case law confirms that YOU won the race? Your defence was in first and acknowledged. Doesn't matter that it was late. You won the race.

It’s a huge relief, as I was concerned I had missed my chance after spending so much time reading through all the helpful information and guidance on this forum. Thank you also for confirming certain points — I had come across some information on a case review before but couldn’t find it again to then ascertain what the relevance of it was, so it’s great to have it all here to refer back to.The parking company involved was Britannia Parking Group.1
