Britannia Parking Group - DCB Legal - post CCJ already set aside - N279 Notice of Discontinuance
Comments

Hi all,Just an update on this - CCJ was set aside, and put back to a defended case. I had my mediation on 5th August, but we didn't reach an agreement, so the case has now been referred to a hearing.I’ve received my court date for 27th November, with a witness statement deadline of 6th November. The letter states that the claimant must pay the trial fee by 30th October. From what I’ve read in previous posts and the Newbies thread, I believe the next step is to wait and see if DCB pays the trial fee by 30th October, and if they do, I should then go ahead and submit my witness statement. Could someone confirm if that’s still the correct plan of action?1

Yes, your plan is correct. Would be good idea to start researching and compiling your WS so that, if they do pay, you are ready, as you will only have a few days between the payment of fee and submission of WS.2

Please edit your thread title to make sense and say which PPC and law firm and that it is 'post CCJ already set aside'.

Thanks for confirming and for all your replies. I’ve been preparing my WS over the last few days and was just about to start pulling everything together when I received a lovely surprise in my inbox this afternoon - an email from DCB Legal confirming that they’ve been instructed by their client, Britannia Parking Group, to discontinue court proceedings. A copy of the Claimant’s N279 Notice of Discontinuance was enclosed.
Is it worth double-checking with the court or MCOL to make sure they’ve received this, or is the fact that I’ve received a copy sufficient?
Many thanks to everyone who’s contributed to this thread and offered advice along the way. Your guidance and support throughout this forum have been invaluable and are genuinely appreciated.
I’ve also updated the thread title accordingly.2

But what about your costs? Hopefully you already had those awarded and paid?

Thanks, felt really chuffed this afternoon, weight off the mind. Regarding the costs, are you referring to the costs for setting aside the CCJ? That was done free of charge as they failed to submit in time. Or are you referring to claiming costs for essentially wasting the time of all involved? I haven't heard or received anything related to this. Thanks again - I honestly couldn’t have done it without all of you.2 Regarding the costs, are you referring to the costs for setting aside the CCJ? Thank you @monkeyboy1978 for the copy of your NoD. I can now get this counted in the DCBL Legal thread of shame. 👍Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
