Currently in divorce proceedings and both living in same house
I have had 5 Police attendances, the last one resulted in my arrest for a sexual assault which alleged was 3 years ago...all of these accusations are completely fabricated
However I now can't return home and it's unlikely I'll be safe to due to further accusations
Now, the house is all jointly owned, the bank account is joint and the mortgage is also...but several of the other bills...the water, the gas/electricity and several others are paid from the joint account but are only in my name....whilst I xant return there and may well be unlikely to do so, am I still liable to pay them ??. We have had the house for sale eith 2 offers that we're 10k over asking price but she has refused to accept and sell
Thankyou

Are there children living in the house? If so what are custody arrangeents?
It sounds as though she is playing dirty to try to retain house but we only have one side of the story.
You need a solicitor. If she is wasting police time she could be prosecuted.
If all else fails a court could order sale.
In the meantime you are liable for all bills in your name0 -
are you still paying money into the joint account?
if so I'd be tempted to set up a new bank account and get any money ( wages etc ) paid into the new account from there.

For utility bills and council tax, tell them that you have left the property and give them her name and contact details. If at all possible provide final readings for gas and electricity meters.

I am in a similar position. I have been advised that as the marriage is still in place it would be unwise to change current financial arrangements arbitrarily. It does make things awkward, but it appears that rules are rules.
I am in discussions with divorce lawyers but haven't initiated divorce proceedings just yet.
The biggest issue for me is the stress and worry. Anybody got some worthwhile blogs, podcasts, forums, or chat sites that could give me some head comfort.
I'll check back in at some point and read what transpires here.
Thank you.0 -
I had similar (not the accusations) and was fortunate enough to scrape enough together to rent. I paid all household bills for 12 months and the mortgage for 5 years until the divorce. In terms of household bills you should settle them to zero and get your name off. Not as easy with a mortgage. Whilst your name is on anything you are jointly liable.
If he/she is agreeable first step should be for you to work out what is/isn’t possible and try to get to mediation. It CAN reduce legal bills considerably and a good mediator will take all circumstances into account.
It sounds as though it is going to be a hard, long slog but life is too short to be unhappy and there will be light on the other side. Some counselling may be good too as it will take its toll, although we all have differing levels of resilience.0
