Hello. I am curious if anyone had any ideas or thoughts on my situation.
I purchased a used electric golf trolley from a local golf club (It was 2 yrs old).
I purchased this as the manufacturer website outlined the battery was well within it's a 5yr warranty.
Upon receiving my purchase, I registered my items on the manufacturer website, where it confirmed the battery was within it's warranty period of 5 yrs, with 3yrs left to run on it.
Unfortunately, the battery soon developed a fault, in that the operating light would stay on and not turn off after use.
Upon contacting the manufacturer about the fault, and to use the warranty, they informed me the warranty was invalid as the trolley was a ex rental, and they only give a 2yr warranty on these types of trolley's.
This meant the battery was 9 DAYS out of warranty.
The manufacturer has refused to honor any warranty, despite when registering the battery, their site acknowledging the battery had 3yrs left.
I asked the company to honor what their website was showing, or at the very least, show some goodwill as you would not expect their products to fail after a short period of time. (And the fact it was only 9 days out!)
They have flatly refused (And have been quite rude in their replies to me!).
The manufacturer is very well known, and has taken me by surprise with their attitude towards my plight.
A new battery would cost the same as I paid for the whole trolley, so that's a no go!
So, do you think I should pursue against the manufacturer, due to the fact this fault is unreasonable to expect within the short age of the battery? And based on their website outlining it was still under warranty.
Or am I wasting my time?.
Any thoughts or help would be much appreciated.0 -
Difficult to say.
You didn't purchase from the manufacturer. Their degree of negligence about their warranty which induced you to buy from a third party might lead to a claim, but the exact wording of the website, which we don't know, will be critical.
A claim against your consumer rights from the trader might be more successful. Did you discuss the ins and outs of the warranty with them when deciding to buy?0 -
A battery on a rental product will get a lot more use than a privately own one.
Hence the limited warranty in what would have been a B2B contract. Were they aware it was ex rental when enquiring about the battery warranty?0 -
i had a bag from a well known golf trolley manufacturer - realistically there are only 2 here so not sure why OP has not named.
even though it was not brought direct i would say the service and help was very good
As already outlined OP needs to take this up with the Golf shop it was brought from, from my experience they will likely have had a spare battery anyway but that would also have been used as a rental so any warranty is likely to have expired.0 -
Was the warranty even tranferable in the first place?1

Its highly unlikely the warranty would be transferrable anyway. Were they aware that the item you were registering had been in use as a business rental?
Its like white goods, the warranty is not valid if the item is for business use rather than private. A golf trolley used for rental could have been use all day every day so its not going to last like a 2nd hand privately owned one would.0 -

The seller, who was selling in the course of his trade or profession, would (or should) have known this.0 -
Did the vendor state or imply that the trolley had a 5 year guarantee or did the OP simply assume that from reading on the manufacturer's website?2
