One Parking Solution NTK

Received a NTK yesterday (22 Apr) but the NTK was dated 16th April then read the bit in the Newbies thread:

"If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to!) the a postal PCN must arrive by day 14 if there was no windscreen ticket."

Can I ask day 14 from what? The contravention? or the date of the letter? As the date of contravention is 29th March?

Also the contravention location is incorrect. Do I have a case to appeal this based on the technical errors?

    Allegation? What went wrong?

    They can't hold the registered keeper liable, as the 14 days starts from the day of parking. Obviously that DOESN'T mean the invoice is 'void' and it won't be cancelled. Nor will you pay.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Location is in Crawley, they actually stated the road name incorrectly too.

    Thanks for your response. It is an allegation of parking where you need a permit. However the signage is in line with other OPS signage and writing was very small. I will follow the steps and appeal.

    How many minutes between the photos?

    They didn't accept the appeal - photos just show all around my car (and also inside the car!) also showed photo of the sign with the small font on. Here is what they said:

    Reason for issue: Failure to Display a Valid Permit / Failure to Display a Valid Permit
    It’s important to understand that that parking on private land that is contracted to and managed by One
    Parking Solution (OPS) is not a right, its conditional, the (T&C’s) apply to all users of the site and are fully
    and clearly displayed on the parking signs (“The Parking Contract”).
    Whilst a consideration period is typically afforded to the driver to read the parking T&C’s sign they must
    either comply with the T&C’s or remove the vehicle from site, a grace/consideration period is not a free
    parking period and will not apply if the driver is making use of the land, in addition choosing to not read
    the T&C’s of parking is not considered a mitigating circumstance it’s a choice.
    When the driver decided to park and/or remain on the contacted land (“The Site”) whilst failing to comply
    with the clearly displayed T&C’s the driver automatically entered into a contractual agreement with OPS
    and agreed to pay the amount stated on the parking contract to The Creditor (OPS).
    During the period of parking, the driver failed to fully and clearly display a valid permit in the front
    windscreen, by choosing to park/remain on site without complying with the T&C's, the driver has
    contractually agreed to pay a parking charge.
    The appeals team are writing to inform you that the appeal has been unsuccessful. The driver failed to
    park the vehicle in accordance with the clearly displayed T&C’s, additionally the appellant has failed to
    substantiate and/or provide sufficient evidence to the contrary.

    The internal appeals team find this parking charge to be issued correctly, we must advise you that once
    the discounted settlement rate (if applicable) passes it will not be offered again, you have now reached
    the end of our internal appeals procedure. You may now either pay the amount due OR appeal further
    with the Independent Appeals Service.

    Some photos were taken at 16:46 and some at 16:51

    I'm not going to bother with IAS appeal, sounds like there's no point from what I've read? Do I just wait now? The other thing is that the location stated on the NTK and appeal response is actually technically incorrect. The car was parked on a different road name, does that help invalidate the charge?

    Also as you said already it was over 14 days from date of parking to receiving the NTK. Does this mean they cannot hold the registered keeper liable?

    Probably not.

    Did you admit to driving? Is the NTK a match for the OPS POFA-compliant one in my NTK pictures thread?
