"POPLA argue that the previous cancellation/concessions were a "gesture of goodwill" from the operator and that the general terms and conditions take precedence. "

I'd call the cancellations as setting a precedence because they took precedent.

ie. they took place beforehand and amounted to a variation of contract.

Not to mention that the retailers are overriding this contract as soon as they make you an offer to sell you a beverage along the use of a space to drink it in anyway. The car park does not exist in isolation in space. It is intrinsically linked with a load of retailers clamouring to attract custom.

Not sure if that argument works as the retailers don't hold the contract with the parking company. They can't do much. Its the landlord or managing agent who holds the contract.

Anyway, as per my last comment and update, both tickets have been cancelled as a result of Savills intervening  on behalf of me (a customer) and overriding the parking tickets.

    Great news!

Savills do the biz once again. The best of all MA's in realising there is no benefit to having genuine customers penalised for the temerity of simply providing custom to the retailers they represent.

Well done on in having the resilience to see this out. Glad forum advice proved helpful. 👍
