MK1 Parking - MK1 Shopping Park, Milton Keynes - Set down/pick up area PCN

Hi all,
My partner received this NTK PCN. The driver is allegeded to have stopped for just over a minute in a pick up/drop off bay and by leaving the vehicle created the charge.
Have written to the shops to see if we could get the charge cancelled but with no luck, so now to appeal.
Parking company's website appeal system is not working, which I have complained about to them already and asked for an alternative means to submit an internal appeal. We note no actual photo of driver leaving the vehicle.
I'm thinking that when it goes to POPLA, as you have commented on another MK1 picture that the NTKs are POFA compliant, that the argument will have to be on the grounds of forbidding contract, and that the driver couldn't have formed a contract in the circumstances (poor lighting of signage, unable to read in allocated time). Does that sound right?

Also study the Joint CoP from the BPA website, consideration periods, as well as there can be no contract for forbidden actions
I cannot see any invitation to the keeper to pay the charge either

One minute. Jeez what utter scammery. This isn't a no stopping red route!
It is clearly reasonable to get out of the car at a set down/pick up bay. Also how on earth would a driver read the terms if they didn't?!
Also - try to decipher that second paragraph in the NTK. None of those incoherent scattergun reasons are 'drivers are not allowed to leave vehicles'.

Coming back here with good news!Two things since my last post
- I filed an internal appeal, to get my POPLA code.
- At the same time I pursued a landowner complaint, and today the PPC came back to me with a cancellation as a result of the complaint
As you might put this in the "complaint to landowner" sticky, a few points:- Parking at this location is operated by two separate PPCs on behalf of two separate landowners. Parking at the north end is via "Nexus" on behalf of the shopping area. Parking on the south side and the drop-off bays that caused our PCN are under MK1 on behalf of the stadium.
- I originally contacted the restaurant to complain, who put me in touch with their landlords, Savills, who use Nexus. This is not who issued the PCN.
- Fortunately the very helpful Savills staff got me to the right place, and by contacting the stadium, I had a follow up from MK1 cancelling the PCN.
- I have a feeling Savills may have spoken direct to the Stadium as during the correspondance they expressed the view that a 1 minute overstay PCN was completely against the objective of parking management.
So if you get an unfair PCN from Nexus, go to SavillsIf you get one from MK1, go to CustomerServices@stadiummk.comThanks again for everything you do here!
