Brighton Council PCN - Failure to display Blue Badge

Hello, I received a PCN for failing to display my valid blue badge. Do I have grounds to take this further? I


explained that due to my disabilities I experience brain fog and have trouble remembering, and this is the first time I had forgot to display my badge. They are rejecting my challenge.

As we major on private parking tickets here, Free Traffic Legal Advice (FTLA) forum will be your best bet for council penalty charges. Register there but please note that a Hotmail address may not work - try using a throwaway Gmail account instead if you do have trouble registering, and post a new thread; here's your link:Read the sticky 'Read this first before posting your case' as well as reading through some of the other threads there ahead of posting your own details, to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate), as they need to see all the small print.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I would have expected that BHCC have a policy of cancelling first time errors for Blue Badge holders so if it were me, I'd wait for the NTO and go again but would certainly get FTLA advice first.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My advice it to follow the appeals procedure and appeal at every stage.I once had a Brighton Council "fluttering ticket" fine: they acknowledged that I'd paid and they had a picture of my ticket where it had blown to on the centre console, with its identifiying code visible on the back, but proceeded anyway; in doing so they skipped a step and when I pointed out that they had failed to follow their documented procedure correctly they cancelled it.Incidentally, it just occured to me that it would be an idea if they printed the ticket on both sides!But anyway, I've tended to avoid going to Brighton since - maybe only twice in the past 10 years...
