Help requested with UKCPS/Moorside legal LOC

Hello all,

Got some questions regarding an LOC I received. Ive had a read of the newbies thread but I do apologise if ive missed something there.

Basically from what I remember, I received a single PCN after parking on a side street near my partner's work place (basically outside the employee entrance). The "contract" used to be that you could park on this particular street for up to 10 minutes, but then they changed this and there was no more parking of any length allowed at which point I started parking directly outside my partner's work (operated by the same people but the workplace has an agreement to allow people to park there for up to 20 minutes.).

So with this being so long ago 2022 I have no idea what the original claim was, but i suspect it was staying longer than the original 10 minutes. When my partner was running late we would inform the staff there and they would ok it and nothing would come of that.

I ignored all attempts to collect from the company and from debt collector's. But now I have received a LOC for 5 separate PCN's.

Ive filled out the template which ill upload after this as its on a different device, but what im wanting to know is:

1. They have added in the !!!!!! £70 extra for each charge. If i do decide to pay them (I know the advice is not to, but I really dont want to be going to court) how would I go about getting this removed from the charge?

2. What proof should i be asking for? Obviously the original PCN's but is there any way to disprove the times that they are claiming?

The claimant is UKCPS

Any help is appreciated.
Thanks

Here's the full letter of what I'm planning to send, again any help is appreciated.

    Dear Sirs,

    Your Ref. XXXX
    Proposed Legal Proceedings
    Claimant: UKCPS Ltd

I refer to your letter of claim.

I confirm that my address for service for the time being is as follows, and any older address must be erased from your records:
    XXXX

The alleged debt is disputed and any court proceedings will be vigorously defended.

I am sourcing and seeking independent debt advice and as such, I formally request that this matter be put on hold for an additional 30 days, in accordance with the Pre-Action Protocol for Debt Claims 2017 ('the PAP').

I note that the amount being claimed has increased by a hugely exaggerated amount which the Government called "extorting money from motorists".

Although my understanding of the terms and conditions of the parking contract may be diminished due to the alleged offence being so long ago, I believe that the original contract allowed for 10 minutes of free parking at the time of the alleged offence. I am aware of this as my reason for parking in this area is that my fiancé works at the XXXX located in Trevelyan square, and on occasion we have informed the staff looking after parking that I may be there longer than this time, which has been agreed between UKCPS and the Marriott Hotel.

I am also aware that this contract did change to restrict all parking unless permitted at which point I moved to collecting my fiancé from outside the front of the XXXX where I have been assured that there is no permits required for 20 minutes of parking, again as outlined in the contract between the claimant and the XXXX.

I would like to add that I have only received a single PCN regarding the alleged offence, but have been bombarded with debt recovery letters. Hence my reluctance to get in touch, as this smelt entirely of a scam.

I have two questions, and under the PAP I am entitled to specific answers:

    1. Am I to understand that the additional £70 represents what you dress up as a 'Debt Recovery' fee, and if so, is this net or inclusive of VAT? If the latter, would you kindly explain why I am being asked to pay the operator’s VAT?

    2. With regard to the principal alleged PCN sum: Is this damages, or will it be pleaded as consideration for parking?

Furthermore I would like to request proof of all alleged PCNS as this has not previously been received.

    Yours faithfully
    XXXX

    1) it's already covered in the defence template by coupon mad

    2) none, nothing at this stage

Use the LoC response template,  unchanged,  remove all the story and background information,  save everything for later,  especially your ammunition,  tell them nothing,  do not ask for paperwork etc, no additions

Ah, UKCPS were originally wheelclampers and are based in Leeds. They had a portakabin round the back of the Blooming Rose pub as their HQ! That's their calibre.
