EURO CAR PARKING FINE

Options
I have received a shock letter from HM Courts for recovery of £270 of costs for the above chased by DCB Legal. I have received no previous letters whatsoever and this letter was delivered to me by a person of a similar postcode bar one letter at the end, being Z not E.  I have serious mental and physical health issues and hold a Blue Badge. I have regular contact with the CMHT.  I do receive benefits. I was parked 30 mins over the limit a year ago at a retail park. There isn’t a ticketing system there which would have helped a lot. I have severe difficulties walking 20m without stopping, there are no mobility scooters available, All my concentration is on pain and struggling, and trying my best to do what I have to do and get home again. I am in my 60s and it does take me longer to concentrate on my shopping. I rarely even leave the house now.  The only time I went to the retail park then that month I remember feeling poorly and having to make urgent use of a toilet facility which was so embarrassing. It was just before an acute admission to hospital for a sudden bowel condition and early kidney failure.  It was a horrible time and potentially really serious. I had absolutely no idea I had gone over the parking limit. It really was the  last thing on my mind. It used to be free. I’ve never had this before. I have a week left to send in my defence to the potential CCJ and no idea how to word it. I have now got emailed copies of those previous parking demands over last year which I have never seen before. I cannot afford this. Court papers…..?  How can I make them see reason when I have missed all their previous demands?? I know that holding a Blue Badge doesn’t make me exempt from parking.

If DVLA don't hold your correct address that maybe reason you haven't received previous letters check your V5C details and for any postcode errors.

Post picture of your Claim form but cover your name address, claim no, vehicle reg, and MCOL password.

You say you have a week left to send in your defence. There is a Template Defence Announcement thread that will help you. Find it on page 1 at the top.

    Did you do the AOS?

When you submit your defence I would suggest including something regarding the Equalities Act 2010.  Due to your disability you cannot be expected to do things at the same pace of someone without that disability and so more time would need to be allowed for you to get to the shop(s) and back to your car.

Just be sure that everything is submitted to the courts on time and this is likely to just evaporate when EURO give in at the last moment.

Post the issue date from the claim form,  top right

I assume that it's from the CNBC in Northampton,  issued by DCB Legal on behalf of ECP  ?

Post a redacted picture of the POC on the lower left of the claim form after hiding the VRM details first

It may not even get as far as a hearing,  not with help and advice from here

But this was likely caused by you not updating the V5C address. That's why you got no PCN letters. Never mind. You have the claim. Easy to defend.

Read any other case.  Literally any thread about a DCB Legal claim. And of course read the second post of the NEWBIES thread.
