BW Legal Parking Fine

Hello All,

I have been following the forums for a while and used to successfully prevent a parking fine from reaching the courts before, to which i am very grateful.

Currently I have a open "Fine" from PPS For not paying for a certain (short) period of parking, but i paid the rest. I have defence for a lot of reasons, Issues with app, poor signage, etc. Have offered to pay the difference but not taken up on this. I had an appeal ready to go to IAS (I know they're a kangaroo court) and had a week or so left in time to appeal but I recieved an email saying my deadline to appeal already passed so am using this as part of my defence.

Recently received the letter of claim from BW Legal, and wrote a robust many-page response as to reasons i won't be paying and am further appealing, to which i have had a response along the lines of "We aren't an appeal service, your appeal was declined previously, client is satisfied balance remains due and owing, should you dispute further we recommend you seek your own legal advice" and that is it. I can't quite find anything in the forums relating to what you do in this case after you send a robust response to the LoC. No action for me to take from this point is too much, I'm willing to go to any extent to prove my point.

Any advice and further steps would be greatly appreciated!

    What happened when you contacted the landowner?

    I can't locate the landowner, it's not part of a chain or retail park its just a car park placed in amongst locations.

    I put the fine in "'s for that reason  :D:smile:

    What exactly happened? Took you a while to pay because the payment methods were unfit for purpose? Did you then also overstay the expiry time on the app? Exact minutes please.

    Please show BW Legal's reply to your dispute. I'm collecting evidence that DRAs are just demanding money and not even looking at disputes.

    It's as simple as i attempted to login and pay when i arrived but i had no signal then when i did try 10 or 15 minutes later (even that was past their "fair time to pay" I just couldn't load the zone with the Zone number and it was only around 1 hour later i could get in. I'm not sure if it was just me or not but i did pay it was just a hour late (so a hour wasn't paid for) .

    I need to see a screenshot here on the thread to use BW Legal's "no disputes now" response as evidence for the Government, thanks!

    Did you pay for the FULL time on site? I did ask for 'Exact minutes please.'

    I believe it is called the Plymouth Athenaeum Car park https://maps.app.goo.gl/tAyS9cqxtRg5QhWK8 , i did reach out to the Athenaeum and they say they have nothing to do with it and that it was formerly a TV Studio car park.

    We all know it already but these "pay up or else" replies prove that BW Legal & their ilk are NOT running anything like 'debt resolution' and are IMHO in breach of the FCA CONC rules and the PAP for debt claims.
