Fine going to court £170

Last Oct I parked in my work carpark and obtained a valid permit from reception which was displayed in my car. I had to sign the permit out and back in.

I received a fine as the car park owner / company said it unclear if it was the permit as it appeared upside down. The permits were supplied by the carpark company.

I appealed and they asked me to send a copy of the permit, front and back. I sent this off with my name on and case reference number, along with a copy of the signing in and out sheet for the permit which showed I had obtained one.

I didn't hear anything from the carpark company. About three months later I received a letter from Trace Debt company advising me to pay £170 for failing to pay my fine.

I rang the carpark company and the lady advised that she had received my evidence but I didn't write my address ok it so it became invalid. No where on the letter did it state that if I didn't provide my address would my appeal be invalid.

I contacted popla they advised nothing could be done as I hadn't received an appeal rejection notice and pin number which they need to investigate.

I wrote a letter of complaint to the carpark company but they said they won't communicate with me further and it was Trace Debts issue.

I've rang Trace Debt and emailed about the situation who have basically said, nothing to do with them either, either pay up or go to court.  They said I had breached my appeal due to not providing my address and data protection meant they couldn't follow it up. I queries that the orginal fine was sent to my address so they had it and they had my name and case reference number written on the evidence.

It's now going to court. I'm extremely worried but also feel angry due to the injustice.  Any advice? Will this impact on my credit rating. Do I need legal advice in court etc. Thanks

    And it wasn't £170. You will never pay this.

    No and no.

    What do you mean it's at court? It isn't.

    Hi, thanks for your reply.  So Trace debt company said they have instructed their legal team to take the debt to court and I can argue my case.   The carpark company is UKCPS.

    I suspect they didn't actually say that but worded it with a lot of ifs.

    I was speaking to a manager at trace debt and she did say the above as I wrote it down whilst she was speaking. She said its a company called Moorefields that will contact me next with court instructions. I've no idea if any of this is true other than what I've written was what she said. Thanks.

    Sorry I've never had to sort out this issue before, I'm not generally easily led but have come on here for some guidance. I can't take back the communication that has passed but would like some advice moving forwards, if you have any please? Thanks

    None of that is correct. Stop phoning these idiots.

    It's Moorside Legal who will send you the LBC, not Moorfields (a famous Eye Hospital).

    Why not just search the forum for UKCPS Moorside and learn from all the other exact same threads? This isn't new or different.

    Scum debt collectors will say anything over the phone - legal or illegal because there won't be any actual record of it. They have to be more circumspect with letters.

    No doubt you will receive a Moorside Legal letter, but they often then slither back under their rock.

    An upside permit is not a court claim I would want to waste a court fee on. It's obviously ludicrous.

    Why ask for a permit if their complaint is that they're unwilling to turn their head 90 degrees to read it?

    Tacitly they've accepted your permit was valid, but they never ever allow appeals so their fake rejection makes them look highly unreasonable.
