Received a letter of claim UKCPS/Moorside Legal

Options
Hi all, apologies if this has been asked before.
I have recently received a letter of claim from moorside legal after been chased by multiple debt collectors over the last 2 and half years. PCN first issued in September 2022. I have got a draft reply from using the newbies posts.

Firstly Do you think they would accept a vulnerability letter as I am currently in the end stages of my pregnancy and haven't really got lots of time to be dealing with this? Will they put an extension on proceedings?

Would it be useful to explain to moorside legal why I am contesting this PCN?

Also since recieving the PCN from UKCPS ltd, the landowner of the retail park (Park gate, Rotherham) has changed after a sale in 2023. Does this have any effect on the PCN that was issued? Do they have less legal jurisdiction to make claim for this PCN now?

Thanks in advance.

I doubt that they will delay anything,  but if you respond by email to Moorside Legal then the probable court claim might not arrive until June, which won't take long to deal with,  on MCOL and then using email,  with our help of course

Do not mention the case,  no explanations,  save your ammunition for later

Its irrelevant,  because UKCPS had the contract at the time that the driver was there, it happened on their watch

This is a roboclaim system, a juggernaut,  so just go with the flow with assistance from here,  you are in the correct place
  • Okay, thanks for that. I was unsure whether the sale would effect the contract between parties.
Just a pain that it's coincided with the end of my pregnancy.

When recieving the MCOL, is it easy to understand? After reading the newbies posts about what to include in the defence all the legal jargon and referencing other court judgements is just completely going over my head. Baby brain I suspect.

Do you copy the defense and then add in one of the paragraphs the details related to my own PCN and why I am disputing the disproportionate charges?
I know I'm not at that stage yet but would like to formulate a response now, so when the time comes it's ready to just be sent given the fact I will have a newborn. If that makes sense.

    Thanks in advance again

Wait for the claim form to arrive,  because it depends on the content in the POC

We will assist you when we have seen the information,  you dont have it yet   !

You will be using a template defence and might be using a rebuttal paragraph against the POC too

Until then you shouldn't worry,  if you follow our advice you will have almost a month to get it right,  so 33 days after the issue date,  if done correctly when we tell you
  • Fabulous, okay.

I'll send the email in response to the letter of claim and pop back once I've had a response.

    Thanks
