UKCPS/ Moorside Legal

Hi all,

Thanks for this forum. It’s kept my resolve up over the last few years. In brief, in 2022, my car was parked outside of a marked bay at Abbey Wood shopping park in Bristol. It was a Sunday, not particularly busy but as my wife was post C-section we wanted to park as close to the shop as possible so  we put my car between two others. It turns out from UKCPS photos that when the neighbouring cars left they had been between spaces. As well as these cars blocking any lines, those present were poorly marked and clearly not well maintained, even less clear in the wet as it was that day. 

My appeal got the expected response, I never revealed who was driving. I submitted a DSAR and annoyed them as much as I could, particularly as they didn’t respond to my DSAR within the required 30 days - even better they claimed they posted it standard delivery meaning all my info could now be anywhere. Ultimately without the info I missed the opportunity to escalate my appeal to the IAS. 

Since then I have been ignoring all correspondence from Debt Recovery Plus and now Moorside Legal. Am I right in thinking this is the LBC I’ve been waiting for? If so I will use the template. Regarding the additional point around if you were not the driver and do not believe their client can hold the keeper liable does the paragraph here apply in my situation? https://forums.moneysavingexpert.com/discussion/comment/80564910/#Comment_80564910

I will attempt to complain to the landowner alongside. Thereafter, am I right that there’s no further action to take until I get the LOC?

    That is definitely a Letter of Claim,  so email the response 

    Continue to try plan A 

    Wait for the N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the next few months

    You can compare your NTK to the pics in my NTK pictures thread to see if it's a match for the wording in a non-POFA UKCPS one.

    Thanks both. @Coupon-mad I’ll dig out the original NTK but I think from memory I assessed this previously as compliant. 

    I’ve added the following details of my dispute to the template response as the guidance suggest I can. Is this ok to add?

    The alleged debt is disputed and any court proceedings will be vigorously defended. Points of note regarding this dispute:

    ·         Your clients failed to comply with their legal obligations under the Data Protection Act 2018, withholding (or indeed losing my personal data within the postal system, if they’re to be believed – you decide which story is legally less damaging), thereby obstructing my right and ability to appeal in full both through the internal process and externally to IAS.

    ·         While my DSAR was eventually provided 3 months later, it was provided without any attempt to confirm my identity.

    ·         As such, your clients failed to follow ICO recommendations, in line with the Data Protection Act 2018, meaning there was no adherence to an applicable time period and an abject failure to ensure appropriate security of personal data, evidenced in emails with your client’s DPO.

    ·         As is clear from the photographic evidence, the parking bay lines are in a poor state of maintenance, even less clear in the wet conditions shown.

    ·         You have no evidence that I was driving, beyond assumption.

    ·         Further key points in this case will be made apparent in any defence that may be required if you continue to pursue this claim that is drowning in incompetencies.

    A failure to cease further harassment will result in me following legal advice in relation to the above failures.

    I think you can send whatever you like at LBC stage. Won't stop them and they won't read it!
