Hi all,

I've been reading through the forums and realised that the letter I’ve received is a County Court Claim Form, and not yet a CCJ—but I want to make sure I handle it properly before it gets to that stage.

There are a few unique aspects to this situation:

  • The Claim Form is addressed to someone who does not live at this address.

  • It's possible that when we appealed a PCM ticket in the past, the form may not have been filled in correctly, which could have led to this confusion.

  • The alleged contravention dates back to 2022. I had to dig around to figure out what it related to and have now found some attached “evidence” images.

I do remember appealing this ticket (see appeal below) at the time, as there were no road markings or clear signage where I was parked. I’m also a resident on the development, and I didn’t hear anything further after the appeal—until now, almost three years later.

I’d really appreciate any guidance on what I should do next:

  • I don’t want to ignore it, as I understand it could lead to a CCJ.

  • I’m not sure how to proceed since it’s not in my name.

  • I genuinely don’t believe I breached any parking rules, but I’m open to advice on that too.

On the 04/10/22, I returned from a night shift in the Met to find a parent on the school run, making claim to our allocated parking spot, this meant I had to find parking elsewhere so I could get some sleep. I found a spot free on the boundary of our development which has been commonly used over the last three years by the local community where there are no road markings and no signage to say this was not allowed. [see photos]

At 08:08 a notice was issued to me with the reason stating I was “parked within a restricted area”. This contravention was not clear and is completely unfair and would not have happened for four reasons,
(1) there are no road markings on the road
(2) There are no signs to indicate this was a no-park zone.
(3) Had the school being doing their job to guide and support parents during their school drop-offs.
(4) Where the boundary of differing private parking companies had been clearly indicated as our car can be parked on the developments land. [see photo]

@ Place) is keen to work closely with the school and develop a sense of community to build the best area we can. I therefore feel that this ticket completely undermines the positive sentiment of living close to the school and goes against trying to build strong ties amongst the local community and schools. I kindly request Parking Control Management (PCM) Ltd cancel this request for payment because of the lack of clear markings stipulating the rules.

    Only the named defendant can defend the claim,  so if that person is not you, I suggest that you pass the N1SDT claim pack to the actual defendant named on the front below Moorside Legal 

    Its not a CCJ, its a moneyclaim,  via MCOL,  dated 10th April,  Moorside Legal are acting on behalf of the claimant parking company,  PCM UK LTD

    The AOS needs completing online on mcol between the 16th of April and the 29th of April,  so preferably later next week,  BY THE NAMED DEFENDANT

    @Omesha, Are you saying the claim form is addressed to a real person who is not yourself or to you with a misspelled version of your name due to a spelling mistake you made when completing a form?

    Did you make up a name?
    Yes, I don't like using my real name on the Internet. So for the appeal it is not real, that seems to have carried through to this, pre-CCJ money claim.

    The claim form is addressed to somebody who doesn't exist. And is likely a carry forward from me completing the PCN Appeal details incorrectly

    Appealing under a made up name might turn out to be a less than brilliant idea.  If you used an alias to file an appeal,  the parking operator can make a reasonable case for suing you under the alias you chose for yourself and registering any ensuing judgment against you personally (assuming they can figure it all out).
