    Does what PRA sent contain everything that Debt Camel says under *How cam I tell its right? " If not then Id stop paying them completely. Keep any money for yourself and only part with it if you absolutely have to.

    Have Lowell provided a CCA? 
  • @tigergambit @1stTimer thanks for this,  yea the best they have offered is 60% and won't budge. The issue is I don't know if what they have provided constitutes complying with a section 77-79 request (Pre 2008) credit card. They claim they have, I argue they haven't. And I know the only really way to test this is in court, but I may go to citizens advice with the documentation they sent and ask for their advice. I want to avoid court as I already have enough stress and want to keep a calm house for by boys. If I can't get them down I may reduce the token payment.

    PRA are vile parasites in my view, ah it makes sense, they are a an American company where as Lowells is European so Lowells has ethics.

    @1stTimer thanks for the condolences, it was a bit of a shock, but he did have a lot of health issues after his heart attack 10 years ago. I am honestly surprised he lasted this long but he always was stubborn. I am just sad I couldn't be there at the end, and haven't been able to get out to see my mother. Being on UC as a carer makes this impossible thanks to capital limits.
  • @Rob5342 yes Lowell did, so can't do anything about that. For PRA because the credit card was pre 2008 I am not sure if the debt camel article is complete, but the legibility is where it fails. the font is so tiny and faded in areas

    In that case one option is for you to ask to reduce the payments to £1 a month and in another year, write and ask them to write off the debt, on the grounds that there is no reasonable chance of your situation ever improving as your son will be dependent on you for the rest of your life. Attach a lot of details about his condition and ask for your request to be handled by their vulnerable customers team.

    I agree with Manyways, in order to gets debt written off, it sometimes takes more than one ask, you have to show them your circumstances are long term, and won`t improve, keep asking every six months/year, eventually your account will be managed by the right department and things may turn out different.

  • @ManyWays @sourcrates many thanks, will try this, I also spoke to national debtline and they said it sounds like the historical terms and conditions don't meet the "easily legible" criteria and I should ask for a better copy and if they don't send it I should contact ICO.

    I have been paying the £5 for over a year so may ask them to write it off.

    Yes, but consider that to be your advantage. Look on this as a low repayment interest free loan whose capital amount is being eaten away by inflation every year.
  • @tigergambit@sourcrates@ManyWays @1stTimer many thanks for your advice, I had feedback from them. They sent an email with a historical copy of terms and conditions, but does not have my address when taken out. I raised this with them. They have now come back and said due to this they have marked the debt as unenforceable.(after I said i was taking the documents to Citizens Advice to verify them.

    So I am now wondering next steps, as debt is unenforceable I am curious to get an idea of how much they would accept? I am thinking 10%?

    I doubt they would consider less than 90%  of what`s owed to be honest, if you are still contacting them for a settlement after been told its unenforceable, then they think they have you on the hook again, and will hold out for as much as possible, as they have nothing to lose.

    What they may lose on this one, they will make back on the next one, its all a numbers game to them.

    My advice, if its unenforceable, and they have admitted that, just walk away.
