ParkingEye CCJ – Was Abroad, Never Received Anything – Want Quick Resolution Without Court

  • Finally heard back from ParkingEye with the same stupid generic response, its like they havent even read my email: 

    Thank you for your correspondence received in relation to the above referenced Parking Charge, which was issued following a parking event that took place on xxxx

     Please refer to our previous correspondence which advised as no defence was filed, nor was full payment received within the applicable time frame, the court granted a default judgment in Parkingeye’s favour.

     At this late stage, Parkingeye would be unable to accept an appeal and we require payment of the full outstanding amount.

     Please be advised that the above Parking Charge has now been passed to Direct Collection Bailiffs and all further correspondence for the above Parking Charge should be directed to them.

     We can confirm that £302 remains outstanding.

    I do feel like no one is actually reading my email, its a win win situation for them too if they agree to consent order! Should I contact Direct collection bailiffs to try to get them to agree to consent? It will be extremely challenging for me to attend a court hearing etc as I am now abroad hence why trying every avenue to get them to agree to consent! I do feel  that if I got through to an actual human and explained the situation to them it would make a difference because this seems completely illogical!

    You already been advised what to do
    Don't waste more time trying to do something which won't work
    Anyone would think you don't want to follow the advice given
    Stop wasting your time and do the full application 
  • Thanks for your response. It’s easier said than done. It is a logistical nightmare for me to organize all of this while abroad and the possibility of flying in to attend a court hearing is dreadful, hence why I wanted to exhaust every avenue first to get them to agree to consent.

    You could ask Contestor Legal to do it for you for a fee (they will try hard to get all fees back from the Claimant if they can). Jackson Yamba can also attend a hearing without you as he is a barrister. Specialists in parking cases and in setting aside CCJs.

    That's a good idea. 
    I would engage them on a representation basis only. Do all the application and await the hearing date from the relevant local court.
    To the reduce the cost to yourself I would ask the cnbc to allocate this to contestor legals local court. As there is no n180 form to request a court .I would write on the front page of the n180(using any free pdf editing website ) why it should be allocated to Leeds......(i will happily DM you some wording to use for this when your ready to submit your application)

    Where in the country is your home court btw (ie nearest decent sized town etc)
