Purchased goods from Netherlands that never arrived

I purchased a pre-order product online from the Netherlands for about £800 using my debit card almost a year ago. 4 months later they sent it using FedEx but the delivery failed and they can't locate the product. The vendor has previously told me they can't process a refund until they receive the product back. 

FedEx are saying the vendor needs to raise a claim but the vendor is ignoring me and I don't think they are going to do it. 

My bank is saying that they can't refund me as it's past 120 days so I'm all out of options and very concerned that I've lost this money.

Is there anything I can do?

    Why did the delivery fail? Was the import duty and VAT paid?

    What was the date the item was dispatched? 
    Given this was a pre order?

    The only thing you can do is pursue court action in whatever jurisdiction the retailer operates, which sounds like the Dutch legal system.  Whether that's practical or financially worth it is another matter.

    According to Dutch law, you can dissolve the agreement with entitles you to the full refund. Problem is that you have to adress your vendor. If that's a reputable one, a letter stating the legal situation might help: Dutch link for an example below.
    If that doesn't work, some reputable vendors are member of dispute resolving organizations, which can help for few costs, otherwise a court case might be necessary, but they are costly and your vendor might be broke eventually. If your vendor is a private person or already considered dubious 
    (check latest link below) 
    then don't bother.
    Do take quick action though.

    Its worth checking, larger vendors will normally accept the jurisdiction of the customer but smaller ones will want their own jurisdiction
