1 month of entering CCJ period (Mar 2025) - Gladstones solicitors/ BW Legal - UK Car Park Management

Hello all, I have gone through the Newbie thread and read the relevant threads. I really would appreciate any help/advice on whether to pay the fees or if it is possible to dispute.

Background:
  • I received circa x3 parking notice letters last year April/May 2024 from UK Car Park Management Limited.
  • I was not parked at any time but alighting to drop off my relative at the entrance of their home which is a development of flats (max 2/3 minutes each drop off)
  • In one of the photos (which is taken by a camera) it shows there was a child playing in front of my vehicle, preventing me from moving my vehicle.
  • I have received a letter from Gladstones Solicitors stating to pay sum £288.56 in 30 days from 26 March otherwise a CCJ will be actioned.
  • I have received a Final Demand letter from BW Legal to pay £340 or it will proceed to Letter of Claim.
  • I have not responded to any of their letters or the original parking notices on the basis that I was never parked which now I regret.

I did receive a letter from the court regarding the claim which I appealed and posted back to the court address. In the past month, I received another court letter saying that I ignored the letter (assuming letter is lost) and not acknowledging the appeal.

Any insights will be massively appreciated. Is there any way to prevent further action?

    Why on earth did you post a defence? That's not what to do. Obviously it was going to get lost. Did you get proof of postage/signed for?

    @Coupon-mad Understood, would this be considered negligence on my behalf and now must pay. I found the court letter for the CCJ , would I need to pay the full amount to UK Car Park Management Limited - is there anything I can do to dispute at this stage without risking a CCJ?

    Also, re Final demand letter - is there anything I can do now with that?

    Final demand received from BW Legal this week:

    Applying to try to set aside judgment costs a £313 fee. And you wouldn't get that back.

    I'd pay the Gladstones one now, to avoid the CCJ. It will be wiped if you pay IN FULL within 28 days of judgment.

    Learn from this mistake and make sure you defend the BW Legal case when you get there.

    Use this thread for this BW Legal case & change the thread title.

    This is an abuse because UKCPM have sent 3 duplicate facts PCNs to 2 different DRAs.

    If BW Legal send a LBC, respond by citing Henderson v Henderson (cause of action estoppel - search the forum for those words). Gladstones have already litigated for this Claimant and should have brought all charges as one claim.

    That's a defence point for you now for the BW one. Plus the fact the car wasn't parked and was only setting down passengers - 2 minutes. Covert photos taken at a distance while you were in the car, I assume?

    That's not parking management.

    But there's probably no hope or point applying tk set aside the Gladstones one, UNLESS you qualify for Help with Fees. Google it if you think you might.
