MET fine (Stansted Starbucks)

Hi guys,
I submitted the appeal using appeal Template given on the newbies thread, that as a keeper I don't agree to accept fine, MET Parking have replied asking for proof of purchase at Starbucks, I missed the email because I understood that the "response in writing" would be sent via post and I waited for the letter without checking the email, now they replied as expected, upholding the charge. They have included the photos and locations of all car park signage and an aerial.

Can I still appeal to POPLA if I failed to give them proof of a transaction in Starbucks?

Of course, but I hope that you did not tell them or infer who was driving ?
Paying or not is not the issue, study recent popla appeals to see what wins
Your appeal should have been as keeper, no blabbing about who was driving , you can see this in action with these 2 recent successful appeals in the popla decisions thread, so study their cases, I linked at least one of them

Winning reason, Non relevant land , schedule 4 in Pofa2012 doesn't apply
The operator has provided no evidence to support their confidence in that the land would be considered relevant land as defined in the Protection of Freedoms Act 2012. That is not to say the site is certainly located within the airport boundary, and different evidence from the operator might have resulted in a different conclusion. But I have made my decision based on the evidence before me

Thanks for your reply, I was afraid I lost my chance when I didn't send them proof of transaction on time. Yes, I didn't give them the driver details and using the template from Newbies thread I appealed explaining that as the owner I am not responsible.I tried to find the cases you write about in the link you posted, but I can't find it yet. When writing an appeal to POPLA should I use only the argument that the fine was imposed on the owner/keeper and I was not the driver and I can't define it? And do I have to refer to some legal basis?
Many thanks0 -
You have not lost your chance, it's nothing to do with payment to the business , and its not a fine, its a pcn invoice ( magistrates issue fines, not private parking companies )
Study the following thread below, which recently won at popla, I assume that you a popla code ?

Study their popla appeal, based on the business being on airport land2 -
Even though they were both posted on that thread the other day? At the end, the most recent posts which you'd obviously read first... not starting at the beginning on a thread that started a over a decade ago!michau7777 said:Thanks for your reply, I was afraid I lost my chance when I didn't send them proof of transaction on time. Nobody is expecting you to write anything yourself. We are expecting you to read the recent posts and to search the forum for the obvious keywords to find MET POPLA cases.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi guys,
Does POPLA have a time limit to decide on my appeal? 8 weeks passed yesterday 30/06
This is part of their last message:
"We expect to make a decision on your appeal 6-8 weeks from the point that the appeal was first submitted."
Thanks

Not specifically. Expect it any time soon, I'd say.michau7777 said:Hi guys,

ThanksPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
