Parking Eye Court Claim

Hello everyone, first of all thankyou to everyone for all your input it has been quite helpful, I received a Letter Of Claim from Parking Eye on October 2024. I followed the guidance from everyone on here and did the AOC and compiled a Defence following the template off this forum, filled out the DQ and also done the Mediation. At the Mediation I declined the offer for a reduced amount however the Mediator seemed to be fully siding with Claimant and telling me that I would lose as these sort of cases always go in their favour. I still declined the offer the Mediation was on 22nd Jan 2025 and 5 days later I received a letter from Parking Eye to say they intend to proceed attached with a response to my defence around 25 pages long. The first page states that the defence has been compiled from an online forum and she has seen many repetitions of these defences lately and went onto responding to my Defence with mockups of signage and where they are located with a mock-up map and images of letters sent to me, but I still haven't received any letters informing of a Court Date as of yet. Parking Eye are representing themselves with an inhouse Litigation Team. Has anyone got any experience with Parking Eye and what happens next?

Parking Eye litigation team usually take it to a hearing, clearly they fancy their chances with an in house claim ( the dubious ones are farmed out to DCB Legal )1

So why was the vehicle allegedly not authorised at that Mosque ?
What do the signs state regarding authorisation in order to park at the Mosque ?
What was the defence ?1 -
The signage is very poor, I had no idea its for members only, The main entrance sign is hidden, and doesn't clearly state it, cant even see the ANPR Camera its attached to a lamp post, it says it in very small writing you need to authorise number plate inside but only when you enter the car park and park up and the signs are 9ft high. I went back to take pictures that's how I know but entering for the first time at night you would have no idea
In the defence I mentioned the POC isn't clear enough, I also mentioned about poor signage as well as inflated costs, I never received any letters regarding it just saw the Claim Form0 -
Not receiving paperwork is usually the fault of the keeper not promptly updating the dvla after moving address, sound familiar ? No previous paperwork is no defence, especially if it was your error
I doubt that inflated fees would win, but might well reduce the judgment amount if you lost
Clearly the signage issues are the main defence here, absent of other key or core details
If you lose in court, a typical loss is around £212, so how much are they claiming, if they win ?1 -
I have mentioned the signage issue mainly, address is the same and Registration on the letter for the Claim its;
Amount Claimed: £125
Court Fee: £35
Legal Representative Cost: £50
Total Amount: £210
Although they are representing themselves but added Legal Rep costs0 -
But was the address correct on the V5c log book on the date of issue of the pcn shown in the POC ?
Several letters will have gone out prior to the N1SDT claim form, so they went somewhere
They have added a spurious £25 to the total, which may come off if you lose1 -
Yes V5C is correct always has been, I checked MCOL and it says it has been transferred to Manchester on 20th January but I still haven't received any letters to say when the hearing is, I have a feeling letters aren't being received.0

Could be a backlog at Mcr court, you can always check with them yourself, seeing as you are a LiP, same as your ECP case ( 10 weeks is nothing these days , some take over a year )1

Ill give them a call on Monday, do I just reference the same case number to them? With my brothers case it says the same Transferred to Burnley but he has a Court Date but mine doesn't I have a feeling I am going to lose, as I haven't seen any cases on this Forum of Parking Eye losing any cases only DCB. I was thinking I'll just pay the £210 and close this its too much trouble to just save £25 in Court0
