Assuming the go down the LBC route, what should be my response?You are totally missing the point here, that is not "your only evidence" the parking company are not an authority they are a company that relies on people making mistakes and breaking their made up rules to extract money from low hanging fruit.They want you to do things like this they only pretend to manage parking, they won't take the slightest notice of your appeal backed by police evidence of a jamb or not.The fact is as far as I can see they claim is you should not have been on site it's no parking so claiming the police blocked your exit is not an excuse.- The car park has no signage at the entrance informing that you should not be entering it as it is a no parking area or permit only area or what ever (you don't know as there is nothing to tell you).
- There is a concealed ANPR or CCTV camera on the wall, I have no idea which as there is no signage warning you, that is breaking the law.
- The only way you can read the terms and conditions is by entering the car park, this is too late.
- The signage with the car park is not prominent.
- The signage is unlit.
- When you do get in the car park the signage as far as I can see is forbidding so no contract can be formed.
- The charge is buried in a wall of text as far as I can see.
- Four minutes evidence of the vehicle on site is within a consideration time of a site where no external signage forbids entry.
You need to get away from the traffic jamb excuse it is not going to work with these scammers (it would be included in a court claim when you throw everything at it) you need to concentrate now on consolidating the contractual evidence if a non scary court claim is brought.As I said earlier Park Direct have been running this same site scam for over a decade and the signage has never got any better, in fact it's worse.They used to be members of the BPA and were seen off at POPLA stage with a forum assisted appeal for defective signage ten years ago.2 -
You'd win this hands down at a hearing in front of a Judge, and you'd get any costs. It is a joke from a joke outfit and ANY judge would shout it out of court, if it got that far.
You cannot have a parking charge notice for 'being in traffic'!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
