I don't think that anyone should be discussing the case at mediation, the mediation stage is to try to reach a monetary compromise, not discuss the case, so I stand by my recommendation and support the standpoint by coupon mad in the newbies sticky thread
But no problem in the call taker stating that the Defendant has proof of payment which will be submitted to the court at the appropriate time
I wouldn't be asking for VRM details etc until the WS stage, putting the onus onto the claimant
Bear in mind that the liklihood is a discontinuation just before the hearing fee is due later this year2 -
We had mediation, told them we were not paying and that we had proof that a payment had been made. We have today received a letter saying it is being transferred to our local court (n271). It states "on receipt, the file will be referred to a procedural judge who will allocate the claim track and give management directions. Details of the judges decision will be sent to you in a notice of allocation"
Does this mean they have paid the fees and we a defiantly going to court or do they still have time to withdraw the claim.0 -
The next letter will be from the judge at your allocated court. That will have the deadline for them to pay their fees.
So discontinuation will probably be in the next 6-8 weeks.

We have had an email today from the solicitors, (despite asking for all correspondence to be via post). They have offered to reduce the amount outstanding form £262.40 to £170.00 in full and final settlement despite us saying to mediation that we had proof of payment. Obviously we don't want to accept, but should we say again we have proof of payment ?0

We received a letter from the court the same day as the email saying the claimant had till the 21st July to pay the fees. We have today received an email from DCBL has been instructed to discontinue the court case and the file is closed.😄4
