Then that is correct and irrespective of any time limitations you have no claim as S75 would not apply in this case.

I appealed  and they replied back that their original decision still stands ..... and it was rejected due to being out of time to lodge a section 75 claim ?? REALY ??? I thought i had 6 years and the reason is different to their first reason !!

5 years in Scotland & 6 in the rest of the UK. Although can be extended in some circumstances...

So you are right on S75 timescales. But so is the rep, in terms of chargeback which would be you only hope of a claim, given it is not your course.
