Free item excluded in conjunction with discount code - not mentioned in T&C's

Hi All,

I purchased an item from an online store which had it listed under a "double deal" in which you get a secondary item free. I also signed up to newsletters which gave me a 10% discount code. I made my purchase and got my item and freebee using the discount with no problems.

The new year came along and I received a larger discount code in one of the newsletter so I thought I'd go down the same route as before but get a slightly different item but still under the "double deal". When the item arrived I only received the main part but not the freebee. The main item had lights which weren't working so was not "as described". I emailed the company and they said that the discount code excluded items that were part of the "double deal" and that they were sorry and would update their T&C's. When I purchased the item there was no where I could see in either the email containing the code or their website including T&C's (then or since) to say that this was the case. Even when you enter the code at checkout was there no indication that I wouldn't be getting the freebee. Is right they can do this and is there anything I can do if so?

    If their terms and conditions said something about discounts not being allowed to be combined (which is pretty normal) then they're covered.  They appear to have admitted that their terms weren't updated, so you are entitled to the deal you contracted for, but they could simply unwind the whole thing and refund you so you're not out of pocket.

    It is quite common that any discount code or any "double deal" (BOGOF? buy one get one free) simply says "not to be used in conjunction with any other offer"

    Is there any small print on the newsletter  about restrictions on using the code with other discounts.
