    I haven’t heard it mentioned and don’t know what difference each makes to mortgage/solicitors cost.
    a £5k discount seems easier to me to get everything cut and dried without expensive solicitors arrangements, so if they want it then I’m sure it can be arranged.

    - and/or maybe the new owner will have to make good the edge of their own drive 


    But all the above seems unlikely, as the boundary was 'mistakenly moved' 30 years ago.

    And I don't think a solicitor would agree to hold a retention for, say, another 30 years "just in case" any of the above happens.

    The neighbour is a council tenant and couldn’t care less.
    its the buyers solicitor (rightly IMO) raising this.

    a retention seems complicated to me and possibly involves solicitors fees and seems over the top for a £5k discount.
