Is this a valid PCN or can I appeal?

I've read the stickied posts and can't see anything relevant to me

Those UKCPM scammers (I say this as they previously gave me a PCN for not parking in a bay... on a site that has never had bays) are back at it again, this time giving me a PCN for "Not displaying a valid permit".

I was displaying a valid permit, but I had not noticed that another unrelated permit had slid down a bit and was covering the top left corner. This includes the first part of the location name.

Here is the photo they have attached to the PCN of my window, and the signage in the car park.


While I accept that the permit was obscured, this still seems a bit scummy. Can I appeal by sending a photo of my valid permit or is this one I've just got to suck up?

    Plan A is always a complaint to the landowner and your MP, both from the keeper without revealing the driver's identity.

    If a cancellation is not forthcoming, then appeal as per the template in blue text you will find in the sticky Announcement for NEWBIES, sent unaltered from the keeper.

    Of course you should challenge this. The permit was displayed so no breach of Ts and Cs occurred. What happened afterwards is outside the control of the motorist. Who is to say that a person or persons unknown didn't bounce up and down on the car, and this jolly jape dislodged the other permit.
    There is enough of the green permit showing to see that it was valid for bay 110, and the term, de minimis comes to mind. (Referring to matters that are so minor or insignificant that they are not worth considering or addressing. In legal contexts, it often indicates that a court will not concern itself with trivial issues).

    The vehicle is a lease so most of that information confused me. Can I not just appeal directly to the parking company if I have a chance of success?

    Yes if you follow the advice and example template by Edna basher at the bottom of the first post in the newbies sticky thread in announcements near the top of the forum 

    But ideally you follow plan A too and get the management company to lean on the parking company and cancel the PCN,  there is no better way or quicker way to make it disappear 

    Appealing takes longer and requires knowledge,  careful wording,  no admissions etc

    Thanks, and to be clear, what's going to happen to the PCN while I do this? I'm still in the stage where I can pay and get a reduced rate. I'm not intending to pay, but I don't want the PCN to escalate in to payment threats while writing and hearing back from these emails otherwise the leasing company will pay it on my behalf automatically when they get a final action type letter. I know appealing directly will effectively pause the PCN while it is considered but how does this work if I'm not appealing directly to the company giving the PCN?

    You do Plan A asap. If a cancellation is not forthcoming then you appeal as hirer/lessee without revealing the driver's identity, which is Plan B.
    As already advised, use the relevant hire/lease appeal letter written by edna basher that you find linked from the NEWBIES just after the template appeal that you will not be using now we know this is a lease vehicle.
    Don't miss the appeal deadline if a cancellation is not swiftly forthcoming.

    Has the lease company transferred liability to you and have you received a Notice to Hirer in your own name?
